AGJ comment: we spilt the Motion up into the key parts so our readers could quickly see what Orly is asking Judge Carter to agree to. AGJ comment: The US Attorneys representing Obama said Carter could not hear the case BECAUSE of Jurisdiction. They maintained that only a court in Washington DC could hear the case because Obama resided in Washington. Orly agreed! — Wow! AGJ comment: Bottom line, Orly made a brilliant move. By agreeing to what Obama’s Attorneys argued for they cannot now go back on their request. Orly in effect called their bluff. Now the case should...

Without a doubt, the most important and significant legal action in the United States this wee, is Dr. Orly Taitz’s Letter to Eric Holder, sent today, demanding that he institute Quo Warranto proceedings against Barack Hussein Obama in the District Court of Washington, D.C.. The importance of this letter is the fact that the quo warranto provisions of the District of Columbia Code provide that a 3rd party may institute a quo warranto action if the U.S. Attorney General fails to respond within 3 months to a request. Dr. Orly Taitz wrote Holder on March 1st. In her letter, published...

*** "After reviewing the moving and opposing papers, the Court finds no factual, legal, or bias grounds upon which to grant the motion for reconsideration. Counsel largely repeats the same arguments made in her briefing and oral argument on the Motion to Dismiss, which is prohibited. To the extent that she does present new argument, it is without merit and does not meet the standard for reconsideration. The Court’s ruling that it lacks jurisdiction, and that Plaintiffs have failed to state a claim on their remaining causes of action, stands." The Amended Motion for Reconsideration is DENIED.

Updates in the BARNETT v OBAMA case in Judge Carter's court: Request for investigation of misconduct in legal proceedings, submission of perjured affidavits, submission of a letter to court by an attorney with improper purpose of covering up criminal activity and obstruction of justice, withholding evidence by attorneys, and US attorneys acting under conflict of interest From 11.11.09. to 11.22.09. A federal judge in Georgia has ordered the US Attorney to collect a $20,000 judgment against Orly Taitz after the Birther attorney failed to pay the fine -- which she appealed -- within 30 days. Here's the full order from Judge Clay Land, of the US District Court in the Middle District Of Georgia:"Orly Taitz has failed to pay the $20,000.00 sanction ordered by the Court on October 13, 2009. Accordingly, the Clerk is ordered to enter final judgment in favor of the United States of America and against Orly Taitz in the principal amount of $20,000.00. The United States Attorney...

Let me first apologize for my laziness and ineptitude for not completing this assignment myself (although I just may), but here's the deal: Wouldn't it be great to complile a collection of birth certificates for every U.S. president from George Washington through G.W. Bush and leave the screaming blank for Barack Obama? On the one hand, it would be fantastic U.S. history. On the other hand, it would put a laser beam spotlight on the current fashion trend of annihilating U.S. history in favor of P.C./New World Order/Greenie Weenie/U.N.owned BULLSPIT. I want to see it. What a cool collection that...

Orly Taitz, Birther Queen, has been rejected again. US District Judge David O. Carter threw out a lawsuit questioning Barack Obama's eligibility to hold the office based on his "natural born" citizenship status Thursday, saying the courtroom is not the proper arena to "challenge a president’s election." Judge Carter dismissed Barnett et al v. Obama et al. This had been Taitz's most successful lawsuit to date, which is not saying much. However, it is the one that got the furthest through the legal system....

We’re not sure it’s exactly newsworthy anymore when a lawsuit challenging President Obama’s election on the grounds that he wasn’t born in the U.S. gets dismissed. (Though rest assured, we’ll be all over it if and when one gains significant traction.) But an opinion issued on Thursday dismissing one of these suits (this one, like others, brought by Orange County lawyer/dentist Orly Taitz) caught our attention. The opinion issued on Thursday, by Santa Ana, Calif., federal judge David O. Carter (a Clinton appointee), delved deeply into standing problems he felt many plaintiffs in the suit suffered. But in the suit...

A California judge has dismissed a complaint challenging President Obama's eligibility to be president citing the "birth certificate from the state of Hawaii" that apparently refers to an Internet image of a "Certification of Live Birth" released during Obama's campaign. The ruling came this morning from Judge David Carter who as WND reported last night apparently recently hired a law clerk out of the law firm that has been paid nearly $1.7 million to defend Obama from such eligibility challenges. A Wikipedia page has been cited by dozens of bloggers after it listed Siddarth Velamoor as one of the newest...

This is news .. the DOJ has officially notified CA Judge David Carter, presently reviewing his next move in the Keyes et al v. Obama et al lawsuit ... of a GA judge's decision in the Kerchner v Obama lawsuit. ______________________________________________________ It clearly shows that Judge Carter doesn’t deserve to be addressed as such the guy is looking for the easy way out while making sure not to upset the Usurper-in-Chief. I may be wrong but Carter has sold out. -David Crockett Maybe Judge Carter was waiting for Judge Simandle’s ruling granting dismissal in the Kerchner case. It came down...

In a stunning blow to the impartiality of the American Judicial system, Federal Judge David O. Carter, who is hearing the case Barnett vs. Obama, in the Central District, Southern Division Court at Santa Ana, California, has just hired a lawyer who works for a law firm where Robert F. Bauer, one of Obama’s top lawyers is a partner. And that, just days before the Oct. 5, 2009 hearing on the Motion to Dismiss, in which his demeanor radically changed, according to Dr. Orly Taitz, esq., lead counsel for the Plaintiffs. Siddharth Velamoor is the lawyer chosen by Carter to...

I will clearly appeal this mockery of justice. Judge Land was totally dishonest and misstated and misrepresented 99% of what was written in the pleadings and what transpired during the hearings. He broke and violated each and every rule in the book: his own local rules, clear precedents, rule of law and Constitution in order to appease this Kenyan dictator and his regime. Will the Circuit Court of Appeals be less corrupt, remains to be seen. We have seen total dereliction of duties by so many in the Federal government, nothing will surprise me.

Federal District Judge Clay D. Land has slapped top birther Orly Taitz with a $20,000 fine for wasting the court's time, among other issues, with her constant filings after he, last month, dismissed her lawsuit against President Obama's right as commander-in-chief to deploy the military because he allegedly isn't legally president. Because he didn't get rid of her the first time, he's hoping she gets the message this time from the barbed language in the 43-page order he issued Tuesday. Right off the bat, on page 1 he writes: For justice to be administered efficiently and justly, lawyers must understand...

Thanks to her "frivolous arguments and disrespectful personal attacks" in court, the lawyer who leads the so-called "birther" movement has been slapped with a hefty fine today for abusing her privileges as a lawyer. In levying sanctions and a $20,000 fine against attorney Orly Taitz, Judge Clay Land wrote that Taitz's most recent court filing, meant to defend herself against sanctions, "is breathtaking in its arrogance and borders on delusional."

Columbus attorney William Mason has seen "birther" lawyer Orly Taitz on television and read about her in the newspaper. He's quick with a description of the California lawyer: "She's nuts," Mason said. “Based on what I saw and read, she's nuts." Mason said her court filings don't appear written by someone familiar with the court system. Also, members of the Georgia bar, to which Taitz doesn't belong, aren't allowed to advance an untrue cause. And, he said, she's never been able to support speculation made in federal court that President Barack Obama wasn't born in the United States. For attorney...

OBAMA Birth Certificate Trial UPdate of Oct 5Santa Ana, CA. - October 5th, 2009, Both plaintiff's Attorneys', Gary Kreep, and Orly Taitz express some concern that 9th Dist. Federal Judge David Carter, has today done a `180 degree reversal from his position of Sept. 8th, 2009, that this case Questioning - Obama's Right by Birth, to be president would go forward for a federal Jury to determine On the "Merits", and is now trying to stall by demanding "standing to sue" issue, Jurisdiction and the ultimate battle axe, "its a Political Question". The three blind mice, ABC, CBS, NBC networks,...

In a 24-page filing littered with all-caps, bold, and underlined text, Birther attorney Orly Taitz is demanding that a federal judge recuse himself in a case that has morphed from a soldier's attempt to resist Barack Obama's orders to what Taitz sees as a prosecution of herself. Taitz alleges that Judge Clay Land met with Attorney General Eric Holder, who was allegedly spotted at a small coffee shop across from Land's courtroom in Columbus, Georgia, on the day of a Birther hearing. A strange affidavit by one Robert Douglas describes the putative sighting of Holder, sans entourage, who "probably thought...

Orly Taitz, Rep. Tim Jones (R-Eureka) and Rep. Cynthia Davis (R-O'Fallon) filed a new set of documents in federal court yesterday, responding to requests that their lawsuit be dismissed. In it, they reassert their allegations that Obama has usurped the Presidency by concealing his "origins," raise more questions about Obama's alleged Social Security number problems and ask for time to amend their complaint to outline Obama's alleged "racketeering" scheme to win the presidency.

...Consider the fanatical support Obama receives from the fringe left and minorities, the “thug politics” environment from which he hails and his association with various radical leftists (including former Weather Underground terrorist Bill Ayers). I doubt Obama would willingly resign even if it was proven he's not a natural born citizen. He and his political machine would instead conjure up yet another racist conspiracy and incite those who have been brainwashed to believe the Ku Klux Klan and the Border Patrol are hiding behind every tree on Martin Luther King Blvd...

Subodh Chandra Add a Cleveland voice to the legal wrangling over President Barack Obama's birth. Former Cleveland Law Director Subodh Chandra waded in Thursday, Sept. 17, with a complaint to the State Bar of California that focused more on the leading challenger of Obama's U.S. citizenship than on the issue itself. Chandra asked the bar to investigate Orly Taitz, a California lawyer pressing cases centering on Obama's citizenship across the country, for making disparaging remarks about a federal judge and for wasting the court's time with frivolous cases. Taitz is an outspoken member of the so-called "birther" movement that claims...

Barnett v. Obama: Important Discovery Is Available Now According To Judge Carter’s Order of Sept. 17, 2009. Today, Judge Carter issued a limited discovery order pertaining to the case of Barnett v. Obama. Judge Carter’s order stated: All discovery herein shall be stayed pending resolution of Defendants’ Motion to Dismiss, except for any discovery as to which Plaintiffs can demonstrate, to the satisfaction of Magistrate Judge Nakazato, is necessary for the purpose of opposing the Motion to Dismiss. Regarding that order, one of my astute readers (Joe The Blogger) asked the following question which led me to write this post:...

(Sept. 17, 2009) — Dr. Orly Taitz, counsel for Captain Connie Rhodes, M.D, filed today an Emergency Request for Stay of Deployment, pending the filing of a Motion for Re-Hearing, in the Case Rhodes vs. Mac Donald. Yesterday, Judge Clay D. Land garnered nationally notoriety for his rejection of Captain’s Rhodes’ case, with a severe ruling that was widely faulted by legal experts across the nation. Attorney Taitz in today’s filings details the errors of Land’s ruling. What follows is The Post & Email’s summary of Tatiz’s Motions, using a copy forwarded us, by Mr. Neil B. Turner. During a hearing in U.S. District Court Monday, an attorney for an Army officer fighting deployment to Iraq questioned Barack Obama’s legal right to serve as president, asserting he was born in Kenya, not Hawaii. Judge Clay Land, inquisitive throughout the 90-minute hearing, said he will issue a decision on Capt. Connie Rhodes’ request for a temporary restraining order by noon Wednesday. Rhodes was represented by Orly Taitz, a California lawyer and a national figure in the “birther” movement that claims Obama does not meet the qualifications to be president. California attorney Orly Taitz, the president of the Defend Our...

A U.S. District Court hearing to determine if a Army captain fighting deployment to Afghanistan because of the challenged the legitimacy of Barack Obama’s presidency was rescheduled for Monday. Capt. Connie Rhodes filed the complaint last week and Judge Clay Land granted an emergency hearing Friday afternoon in the Columbus federal courthouse. Rhodes, a medical doctor who was with her unit in Fort Riley, Kan., did not attend the hearing. That prompted Land to reschedule it for noon Monday. Rhodes is scheduled to arrive at Fort Benning Saturday and deploy within seven days. Rhodes’ attorney Orly Taitz — a national...

In the federal lawsuit claiming that Barack Obama cannot legitimately be president, today’s hearing in Santa Ana focused not on documents that allegedly prove he was Kenyan-born but on the conflicts of plaintiff’s attorney Orly Taitz. Judge David O. Carter dismissed Taitz’s motion to have two of her clients removed from the case and also tossed her motion to have Magistrate Judge Arthur Nakazato removed from the case. Carter said there was no basis in Taitz’s complaint that Nakazato was biased against her in an earlier administrative ruling. Additional, Carter told Taitz that she had no choice but to work...

As of today, September 4, 2009, this Affidavit has been filed with the United States District Court in Southern California ~ represented by Orly Taitz. This is a legal affidavit that declares Lucas Smith to be of sound mind and judgement. Lucas can go to jail if he lied on this affidavit. The document (Certified COPY of Obama Kenyan Birth Certificate) you see here, once it is validated by the court, is pretty much the proverbial “smoking gun.”

Over the last two weeks, Taitz has been featured in a segment on Channel 10 television’s popular nightly news show “London and Kirschenbaum,” filmed a segment for the far-right Arutz 7 Web site and recorded a show for their radio channel, was featured in a three-page article in mass circulation daily Ma’ariv, and was the subject of a feature on Channel 1 TV. Israel’s Russian press has also taken notice, and interviewed Taitz for a feature for Russian radio and Israel’s Russian-language Channel 9. Taitz will also be the subject of a lengthy article in “Vesty,” Israel’s largest Russian-language newspaper.

U.S. President Barack Obama's domestic and foreign policies pose "a clear and present danger to Israel," says the driving force behind the campaign to prove Obama was not born in the United States and therefore ineligible to serve as president. The so-called "birther" movement that alleges that Obama was born in Kenya found fertile ground for publicity during the perennially slow news days of late July and early August. As cable and online news outlets devoted more and more time to the phenomenon, Israeli-American activist Orly Taitz emerged at the forefront of the campaign, and her star steadily rose until...

In the lastest quirky drama of Mission Viejo attorney Orly Taitz's lawsuit to get President Barack Obama tossed from office, she has filed a motion today asking that Magistrate Judge Arthur Nakazato by removed from the case. She says that Nakazato is holding up the case by being "hyper-formalistic." On Aug. 1, Taitz filed what she said she thought was a Kenyan birth registration for Obama. You can read here about evidence indicating it's fake, but the reason Nakazato threw the filing out was because Taitz didn't have her paperwork in order. In her motion today dismissing the shortcomings as...

Orly Taitz, the Mission Viejo lawyer trying to get Barack Obama thrown out of office, says she's had enough of two of her clients in the case and will continue without them. Whoa, say the two. "This is our case," said Buena Park Pastor Wiley Drake, one of the two plaintiffs Taitz has unilaterally tried to have removed from the case. The lawsuit challenges Obama's birthplace and his legitimacy as president. The latest chapter in the drama started when Drake and Markham G. Robinson notified Taitz that they were replacing her as counsel. Taitz continues to represent 40 other plaintiffs...

TAMPA, Fla. – An American soldier questioning the eligibility of President Barack Obama to hold office has had his latest legal challenge dismissed "as frivolous and wholly without merit." The Aug. 6 ruling by U.S. District Judge Richard A. Lazzara came less than two hours after motions were filed by Maj. Stefan Cook, a member of the U.S. Army Reserve who is seeking a firm determination whether the commander in chief of the Armed Forces is a "natural born citizen," a constitutional requirement for those holding the presidency. "There was no reasoning, no nothing," said Maj. Cook, who noted previous...

Orly Taitz is an attorney. She's also a real-estate agent. And a dentist. But when Taitz isn't in court, showing homes or drilling teeth, she's become the wide-eyed queen of the so-called birther movement — that subset on individuals who still, despite all evidence, don't believe Obama was born a citizen of the United States. She's leading the calls for Hawaii to release Obama's "true" birth certificate (though Hawaii has already released Obama's Certification of Live Birth) and has even produced what she purports to be Obama's true Kenyan birth certificate (though experts have deemed it a forgery).
