  • Congressional Duty vs. Discretion. Article V.

    10/05/2015 7:23:46 AM PDT · by Jacquerie
Our Constitution details both duties and discretions to its member states and three branches of government. Duties involve commands that must be obeyed, while the exercise of discretionary power is of course, optional. For instance, Congress has the option to implement enumerated, delegated powers such as those in Article I Section 8. Congress does not have to write statutes involving taxation, commerce, naturalization, post offices & post roads, etc. It may do so as it sees fit. These are specific grants of power from We the People, which when used as intended, facilitate the general welfare and blessings of Liberty....

Article III Clause 2 of the Constitution states: In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make. Clearly, Congress has this power. So why haven't they used it? They have in years past.According, to seminal decision on jurisdiction-stripping statutes under the Appellate Jurisdiction Clause came shortly after the Civil War. Ex parte McCardle (1869) involved a newspaper editor in military custody, who had appealed a lower federal court's denial of habeas corpus relief to the United States...

  • How to Prevent an Article V State Amendments Convention . . . Forever

    09/23/2015 1:42:37 PM PDT · by Jacquerie · 35 replies
If I wanted to surreptitiously prevent an Article V State Amendments Convention, I would plant a seed in the media that state legislatures must submit to congress, identical or near identical applications that deal with a particular topic. For instance, should ten states apply to balance the national budget, and another ten applied to enact congressional term limits, while another ten sought repeal of the 17th Amendment, I would inform congress and the media that only ten of the required thirty-four (two-thirds) applications had been presented. Obviously, this is an easy sell to congress; there is little reason for congress...

Fox in the Grassroots Henhouse: The Perp Sheet The FNC jihad against Donald Trump, grassroots America and their own viewing audience There was a time, not so long ago, when grassroots conservatives believed, rightly or wrongly, that the Fox News Channel was an alternative to the manipulative, often shady ways of the alphabet networks. As of late however, it seems that the VIPs at the network are beginning to more resemble the pigs-turned-human at the end of Orwell's Animal Farm than the friendly alternativnes to the mainstream media clampdown. The possibility of a Donald Trump nomination for the GOP is looking stronger by the day. Barring a completely unforeseen event, he is going to be the likely nominee. He is currently leading in every single state primary poll save two, WI (Walker) and OH (Kasich). Both of these are weeks old, and in both cases you have incumbent favorite son governors. But recent polling from AL, AZ, CA, FL, GA, IA, ID, MO, NC, NV, NH, OR, SC, TX---plus doubtless a couple I've missed---have Trump in the lead. In some cases, the lead is 20 or even 30 points....

Conservative media frequently features post mortems on the American Republic, why the greatest experiment in free government failed. Our demise is attributed to various causes, but the most common accusation centers on our collective failure to keep the republic. Part I established why the states should immediately gather in an Article V amendments convention to restore the American Republic. The convention could remain a permanent institutional feature of the American governing scene by never adjourning sine die, and resolve to meet, for instance, on a particular day the following year. American style hard tyranny isn't conjecture; it is here and will get worse if we do not reclaim powers stolen from, and rights denied to us by the Uniparty apparatus. Our highest institutions, including the electoral process, have been corrupted to the point they serve ends opposite to those intended, and are therefore incapable of restoring freedom. The question to be answered is, “How shall we reclaim liberty?” We must appeal to first principles, to eternal truths that span time from the Creation to this very moment. One of those truths is that the only legitimate powers of government are...

Our governing system no longer serves its intended purpose, to secure the blessings of liberty. Any casual read of the Constitution reveals our government’s wholesale departure from it. Congress gaffs off or assigns its duties to craft legislation, determine spending, ratify treaties, oversee the executive branch, and regulate the judicial branch. Not being content with rewriting statutes, Scotus increasingly elevates itself above God; its Obergefell v. Hodges ruling is only the latest outrage among many. Executive branch agencies reflect the will of one man, Obama, and not congressional statutes. In response, there is a small but growing minority of Americans...

Politics is about name-recognition and none of the other candidates besides Trump has the name recognition to challenge Jeb Bush or Hillary Clinton. Therefore, Trump is the only candidate with a chance to win who has promised to do the only thing that matters.

Today, many reporters and political observers are scratching holes in their heads wondering how Donald Trump not only has maintained his lead in almost every state, unbroken, but has now done the politically impossible and reversed his "unfavorable/favorable" numbers. Except "reversed" doesn't quite explain the astounding (to some people) inversion of the numbers. As Washington Post's Chris Cilizza gasped, Trump went from 27% favorable/63% unfavorable in the May Des Moines Register poll to 61% favorable/35% unfavorable in the latest poll. But it's not the only one. Several other national and state polls have mirrored this tectonic shift. Pollsters and focus-groupers,...

Thanks in very large part to The Donald, the illegal immigration issue has come raging to the fore in the consciousness of a great many American citizens (and others) in recent times. People are not only thinking about the issue, but they have started talking about it, oftentimes with great passion. And this is so regardless of which side of the dispute the contenders align with. Matthew 25:40 And the King shall answer and say unto them, Verily I say unto you, Inasmuch as ye have done it unto one of the least of these my brethren, ye have done it unto me. Lamborghinis matter more than the sanctity of life to abortionists. We are now getting a very up close and personal look at the monsters who run Planned Parenthood and it is desturbing. To imagine that the one thing a girl wishes her entire life for which is a baby is turned into human body parts to be sold like a butcher shop turns...

This is Free Republic. Our mission here is to fight against the America-hating, God-hating, capitalism-hating, abortionist/homosexualist leftist revolutionaries and marxist/fascist totalitarians who are hellbent on destroying our constitution, our religious freedom, our economic freedom, our Judeo-Christian way of life and the America we love. Pro-life, pro-family, conservative Catholics, Protestants and Jews are not the enemy. All pro-life, pro-family pro-America believers in our one true Judeo-Christian God are our guests, friends and allies in this effort, so please quit attacking your allies! Your attacks are not going to convert anyone. Please save your ammunition for the enemy. We’re on a mission...

Towards the end of the video where John McCain's betrayals are exposed By Vietnam Vets And POWs: are found the remarks of former Congressman Dornan's which are accurate and highly plausible but are missing a vital part that deconstructs John McCain's character and the myth about his 'heroism'. Here's the context with reference in italics to the Hanoi Hilton's POW Commanding Officer Admiral James Stockdale in his own words: Admiral (then a USN Captain) Stockdale and all other POWs inside the Hanoi Hilton confirmed the only way to come home early was if Admiral Stockdale granted permission; there was...

Leviticus 20:3 And I will set my face against that man, and will cut him off from among his people; because he hath given of his seed unto Molech, to defile my sanctuary, and to profane my holy name. The week began with Joseph Mengele’s wife discussing the barbaric dissection of babies for profit over salad and wine and ended with a fellow cultist murdering four of our unarmed Marines. These two sick human beings are mirror images of each other worshiping the same religion with the exact same results, the deaths of innocents. When you worship a Godless religion...

The Islamization of America: From Mecca to Medina and conquering Americans from within 8/6/2006 - By Aland Mizell Many times the Ottoman Empire tried to take over the whole of Europe but failed to do so. The Ottoman Empire could not conquer the West by sword, but now Muslims are using a different strategy to conquer the West to bring it under the Islamic realm. Today the West is being the victim of their own values, such as freedom of speech and _expression, so that Muslims are using ‘Democracy’ as a tool and taking advantage of democracy to disseminate...

Acts 7:22 And Moses was learned in all the wisdom of the Egyptians, and was mighty in words and in deeds. All the professional prognosticators are dismissing The Donald’s chances of winning the nomination. These same people were the first to call him a clown and every other demeaning term to prove their sanctimony and knowledge even though the only thing they exceed in every election is picking the wrong winner. The one thing the echo chamber will never do is go against the group think and predict something as outrageous as the two left standing at the end will...
