Chief Justice Roberts Defends Kagan, Thomas Hearing Health Care Case

In the face of a growing controversy over whether two Supreme Court justices should disqualify themselves from the challenge to the 2010 health care overhaul law, Chief Justice John G. Roberts Jr. on Saturday defended the court’s ethical standards.

The chief justice’s comments came in his annual report on the state of the federal judiciary. In it, he made what amounted to a vigorous defense of Justices Clarence Thomas and Elena Kagan, who are facing calls to disqualify themselves from hearing the health care case, which will be argued over three days in late March. He did not, however, mention the justices by name.

“I have complete confidence in the capability of my colleagues to determine when recusal is warranted,” Chief Justice Roberts wrote. “They are jurists of exceptional integrity and experience whose character and fitness have been examined through a rigorous appointment and confirmation process.”

Federal law requires that judges disqualify themselves when they have a financial interest in a case, have given advice or expressed an opinion “concerning the merits of the particular case” or when their “impartiality might reasonably be questioned.” For lower court judges, such a decision can be reviewed by a higher court, but the Supreme Court has no such review.

We shall see, my prediction remains the same, they will not overturn it.

Of course the correct thing for Roberts to have done is keep his mouth shut on the Kagan issue.

That might be a bit rash — at this point all Roberts has done is stand up for his colleagues. It’s too early for him to opine about who should or should not stand down. If anything, perhaps he should have said nothing about it at all.

He is probably smart enough to know that Kagan and Thomas will likely take opposite sides of the Obamacare issue, so they will cancel each other out.

I am optimistically predicting that the court will overturn obamacare 5 to 4 with Kennedy being the tie-breaker (as usual).

“Great” men are known for great deeds. What exactly has Roberts done to be considered great? Certainly not challenging 0bama.

I disagree. I won’t waste my time on educating anyone for that matter, especially someone that really is unfamiliar with the rather huge effect Roberts has had on the philosophical direction of the court. I’m sick of ‘conservatives’ who eat their own...as my tagline repeats...no better than Obama.

‘sons of liberty’ always give up, apparently. During the revolution they were always very close to losing and not being financed...often failing greatly. It’s great we didn’t have people like you...who turned their back on it.

It is my personal opinion that the SC is going to find obamacare “Constitutional”. What rationale they will use ti come ti that conclusion is beyond me.

My opinion also. History will later show their ruling to the the practical end to the "Great Experiment", The American Republic. Of course it is very possible that contemporary events will be rewritten and refabricated by the left, as it has done with our previous history. The same way the Soviets erased deposed party officials from history.

The Left wins again. By any reasonable jurisprudence Kagan should have recused on Obamacare but the Left cannot have it. Hence the massive Clarence! Thomas! Must! Recuse! campaign which had no serious purpose except to establish a rough equivalence between Thomas and Kagan on this issue. Which apparently worked.
