The Tax You Need Not Pay
American Thinker ^ | July 10, 2012 | Jon N. Hall

Except for the decision on the expansion of Medicaid, ObamaCare largely survived the scrutiny of the Supreme Court. However, the individual mandate is gone; the Constitution does not allow Congress to command Americans to own health insurance. ObamaCare survived because Chief Justice John Roberts magically transmuted the penalty (for noncompliance with the now-defunct individual mandate) into a tax. But on page 39 of the decision, we read:

It does not apply to individuals who do not pay federal income taxes because their household income is less than the filing threshold in the Internal Revenue Code. §5000A(e)(2). For taxpayers who do owe the payment, its amount is determined by such familiar factors as taxable income, number of dependents, and joint filing status.

So not only does ObamaCare tax the individual, but that tax is a part of the Individual Income Tax. But when judging the characteristics of a tax, one must ask: what does the tax assess?

Can it really be true that we don’t have to pay the penalty. I am one of those individuals just above the threshold. I can withhold less so that the IRS can not keep the money. And I understand that they cannot seize assets. But, someone said that they could still sue me. Is that the case?

So the only effective part of the law is that it will destroy the insurance industry. Pelosi, the mother of liars, is lying when she rants on free riders. She loves the free riders because they are the tool to destroy insurance. On to single payer. How long will that take; one year, two?

I've heard it said that there are 21 new taxes in the bill, but can't confirm if it is true or what they are. Who has time to read it all?

From what I understand, the home sale tax applies to either those over a certain income, or sales over a certain amount....can’t recall...

Wiping out the health care insurance industry?

WTF?

Am I correct that the Health Care Insurance Industry in America is something like 16% of the economy? I seem to remember that figure from previous reading here. Is it correct?

But with ObamaCare, there's no enforcement -- it's a toothless tax.

Based on the Orwellian government we serve, "no enforcement" is subject to their interpretation, or reinterpretation at any given moment.

I am not reassured by anything I see or hear.

This is not a government, it is a freak show.

Wiping out the health care insurance industry?

Yep. That is the end game. Sort of. Obama is on record as saying that he favors single-payer insurance. Single payer is code for the government is the ultimate underwriter. In the quest to nationalize health care, something like nationalizing health insurance is an intermediate step.

Now that will not mean the end of all health insurance companies. The government does not have the infrastructure to administer all of it — at least not yet. So the system will, for a period, end up like Medicare, where there are insurance companies that act as payers and fiscal intermediaries, handling claims and payment on behalf of the government. Today the largest group that does that is Blue Cross/Blue Shield (in various flavors). They have the most political clout and will likely experience less damage than the other insurance companies.

In the wake of the ruling from SCOTUS some insurance companies have already begun downsizing. And as of yesterday, I was one of those downsized (along with 20% of their marketing personnel) from one of the largest non-Blue insurance carriers. I distinctly remember the first time I read the first part of the stupid bill. I knew then that my days were numbered.

Sadly, it was not just the days of my job that were numbered. Unless Obama and his puppet masters are voted out, it will be the Republic whose days are numbered.

To get the bill passed, congress added a provision that bars the IRS from using any collection mechanisms to collect the tax. They can not garnish your wages, seize your assets, take you to court or put a lien on your property. The only thing they can do is withhold any tax refunds you may be due now or in the future and send you bills and nasty letters. (of course with that being said, the law could change at any time in the future and I wouldn't want to owe 20 years of back health care fines when a future congress decides to let the IRS use all the powers at it's disposal to collect them.)

To make it retroactive like that would ensure a BIG fight in Congress. I think I will risk it (not that I think I will have to, because I think the thing will be repealed). But, if there is absolutely no enforcement mechanism, then millions of people simply won’t comply. What a stupid law!

Who has time to read it all?

One of the problems is that it's written in lawyer language instead of English - I was scratching my head on a lot of things.

Nevertheless, something is in there for someone, and I don't like it a bit. Not for me and not for thee.

I fear Congress will let much of this bill stand, as is. They WANT money in their private chest. Even if they get rid of the Health ins. tax, there will still remain how many more taxes that only they know is there.

I want nothing less than the WHOLE stinking bill done away with, and leave no residue.

""""I've heard it said that there are 21 new taxes in the bill"""

Exactly my point. We don't know and neither do our ANY of our Reps nor Romney.

While we are complaining over the ACA insurance tax, they know we don't know all the other surprise taxes in that bill. We need nothing less than that ENTIRITY OF THAT SHITTY BILL repealed and leave not one iota of residue.

The purpose of O-Care is simply to raise revenue on the one-hand, and limit-out -go on the other.

Everyone will be paying for “healthcare” ....no one receiving.

The RinoCracy needs more of your money with which to continue to have their fun.

LOL, yes, the poor. Because we all know that we can determine one's status of wealth based on their taxable income.

Amen. We know they won't do it, neither the R or the D's want to overturn this monstrosity. What they are doing now in the Repeal debate is ALL SHOW, nothing more.

The R's & D's, do not/will not REPEAL this, it is about filling the Congressional coffers with TAX MONEY, that they will then rob and spend on themselves. They will vote themselves a payraise, hence the Judges get a raise. See the tie in now of why we lose in courts?

It is nothing more than another PONZI scheme, and the PONZEE (taxpayer)gets scammed, they never will get enough of our money for them to spend, NEVER.
