The epic battle between American Freedom Defense Initiative executive director and blogger Pamela Geller and The Metropolitan Transportation Authority (MTA) culminated with a court decision that forced the transit authority to permit the display of controversial ads about radical Islam. But the story didnt end there. As TheBlaze reported this morning, Gellers case caused the MTA to rethink the manner in which it handles First Amendment issues, leading to the adoption of some potentially-controversial measures.
On Friday, TheBlaze spoke with a spokesperson who confirmed some of the details surrounding the case, while clarifying the new changes that passed on Thursday. As noted, one of the emergent provisions that was added into the public companys advertising standards in the wake of the Geller debate allows the MTA to deny ads it deems could incite violence.
As previously noted, a document, reflecting yesterdays changes, was released by the MTA to TheBlaze this morning. It highlights the transit authoritys advertising standards and reads, in part, The licensee (advertising contractor) shall not display or maintain any advertisement that falls within one or more of the following categories. One of the category sections reads:
The advertisement, or any information contained in it, is directly adverse to the commercial or administrative interests of the MTA or is harmful to the morale of MTA employees or contains material the display of which the MTA reasonably foresees would incite or provoke violence or other immediate breach of the peace, and so harm, disrupt, or interfere with safe, efficient, and orderly transit operations.

CONSERVATIVES ANTI-JIHAD SUBWAY AD LEADS TO NEW POLICIES: NYC AUTHORITY CAN NOW BAN ADS THAT COULD INCITE OR PROVOKE VIOLENCE
Ok, then let file complaints against all the various Leftist pro Obama ads because they might incite violence
Unconstitutional and SCOTUS would hopefully overturn this practice.
But they will only do so against ads “hurtful” to Islam. Anything that Christians would consider “mean” will be said to “protected under the First Amendment”. Free speech is now dead in NYC.
Here we go................
any images involving the above person can incite me to violent convulsion resulting in projectile vomiting or dry heaving combined with momentary tourette's
it should be banned
It’s the first cut. Everyone in this country will look at it and say, “oh, that’s just a flesh wound,” and the practice will go on.
It’ll spread to L.A. and Chicago. Then to Miami, Houston, Atlanta.
Before long that “flesh wound” becomes a hemorrhaging gape, and that’s how the socialists take power.
Obama is diligently trying to destroy the first amendment. It’s one of two remaining rights that we have left. The last one will be the hardest, but even with the 2nd, I fear it’ll be too late.
Sharia has arrived.
If Muslims will be violent (D’oh!) you can’t say it.
First Amendment be damned.
So the Metro Transit Authority, bureaucrats who can't make a train run on time or turn a profit, are now the arbiters of what constitutes free speech. I wonder if they will don black robes when they render their verdict?
All nonmuslims must ride in the back of the bus so as to not offend Muslims
Where’s the ACLU?
The Constitution is obsolete and irrelevant. SCOTUS is all that matters in today's post-constitutional Amerika.
so, all one need to do is to claim “the ad caused me to be violent” and by that standard the ad is guilty
were the MTA a private enterprise - it’s not, it’s a government agency - I’d have no problem with them making any advertising rule they want
as a government agency, they must meet the standard that the government cannot abridge freedom of speech, at least not without “just cause” (yelling “fire” in a crowded theater) but, judging in advance how someone might react to an advertisement with violence is always a subjective and political judgement that any U.S. government needs to stay out of
So this means all election campaign posters and signs too? Every time I see an Obama 2012 bumper sticker or sign, I become very “incited” and “provoked”. I don’t suffer fools graciously.
Are they just afraid of the Muslims?
I always thought California was going to be the first state to go Sharia
"Sauce for the goose is sauce for the gander."
Anti-blasphemy laws managed by the Mullah Transportation Authority.
So I guess they’re saying that muzzies have tendencies toward violent reactions.....
And the lesson learned is that violence works.
ACLU will be right on this as soon as the 10 commandments get posted on the bus.
They are smiling with joy.
The leftist ACLU is like all on the left -- hearts filled with pure evil and with a lust for absolute power.
The death-knell of free speech. Anything and everything can incite violence—from “Please don’t walk on the grass” to “Jesus Saves.” Never mind that the da** film had nothing to do with the murder, the embassy attacks, or the demonstrations!
Who would have thought that New York would be the first to fall to Sharia.
I always figured Detroit.
I guess that means no Republican campaign ads............
Your comment has been noted and you have been counted.
You are Thought Criminal #27483309
Write down your number and report to the local Kommissar at the nearest railroad station.
Dont forget to bring warm clothes and a shovel.
Pam Geller will be all over this.
An obvious attempt to evade a court ruling.
So no more anti-Christian ads?
remember the atheist group than ran ads?
Fixed. NYC needs to read up on the First Amendment, specifically "chilling" free speech.
I suggest staging fist fights over commercial ads like Calvin Klein’s and other corporate advertising. Make it impossible for anyone to advertise and see how fast this gets reversed.
Obama: “Hmmmm MTA? Hot damn! take this down. Executive order Number dot dot dot. . . Internet postings and opinions aired on radio talk shows that are directly adverse to the social or administrative interests of the world community or are harmful to the morale of the world’s peoples or contain material the display of which the United States government reasonably foresees would incite or provoke violence or other immediate breach of the peace, and so harm, disrupt, or interfere with safe, and orderly . . . .”
We could use all the MSM articles about violent, racist, "tea baggers" spitting on Nagy Piglousy and shouting racist remarks at others as justification. Maybe even some of the ones where the Tea Party was initially blamed for things like crashing small planes into IRS buildings.
Their agitprop could be used against them.
They better not put up any ads with Sarah Jessica Parker trying to look sexy. If they do, I will take out an entire train of innocents!!!
Ban all Obama ads NOW!!!!
I’m enraged and want to spray paint something pink!!!
What happened to the old “clear and present danger” test? Not that I like that one, either.
This is not the “chilling effect.” This is directly violating free speech.
I guess when you cross into New Yawk you give up your Constitutional right to free speech and to a Big Gulp.
Free speech banned
Free thought outlawed
Prior restraint ?????
No worries...there are never any Republican campaign ads. However, Manhattan Mini-Storage features anti-Bush, Cheney, Palin and Republicans in general messages in their ads which we've been subjected to for years.
Big Brother is Watching You.
placing crosses in urine, or utting turds on the picture of the Virgin Mary is art AND ALL ok.
kIDS CANNOT HAVE SODA OVER 16OZ, kids can;t have cold candy or sore throat candy in the school, kids can;t buy cold medicine , salt is not allowed in school but hey get a tablet to kill a baby because the 13 year old girl coudln;t keep her legs closed is alright.
NY city might as well join MA and the rest of the north east and form their liberal socialist no common sense, no freedom of speech for the right utopia .
And they can take all their liberals who moved down here too
