Opinion on People who illegally park in Disabled Parking Spots

This is what the State of Indiana Code states:

IC 5-16-9-5 Violations; Class C infraction and Class C misdemeanor Sec. 5. (a) Any person who parks a motor vehicle which does not have displayed a placard of a person with a physical disability or a disabled veteran, issued under IC 9-14-5 or under the laws of another state, or a registration plate of a person with a physical disability or a disabled veteran, issued under IC 9-18-18, IC 9-18-22, or under the laws of another state, in a parking space reserved under this chapter for a vehicle of a person with a physical disability commits a Class C infraction. (b) Any person who knowingly parks in a parking space reserved for a person with a physical disability while displaying a placard to which neither the person nor the person's passenger is entitled commits a Class C infraction. (c) Any person who displays for use in parking in a parking space reserved for a person with a physical disability a placard or a special license plate that was not issued under IC 9-14-5, IC 9-18-18, IC 9-18-22, or under the laws of another state commits a Class C misdemeanor. (d) A person who, in a parking space reserved for a person with a physical disability, parks a vehicle that displays a placard or special registration plate entitling a person to park in a parking space reserved for a person with a physical disability commits a Class C infraction if that person is not, at that time, in the process of

transporting a person with a physical disability or disabled veteran. (e) Notwithstanding IC 34-28-5-4(c), a civil judgment of not less than fifty dollars ($50) must be imposed for an infraction committed in violation of this section.

IIRC, stupidity and lack of consideration are not covered by ADA. At least not yet.

You beat me to it ...My wife is disabled and I can let her out at the door and park anywhere but she goes in and there are no scooters but teen age boys racing down the aisles

I have a handicap plate because I have severe arthritis. Just before Christmas I was waiting to make a left turn into the only remaining handicap space at a local grocery when a young man in a Jeep made a right turn and took the space. He was obviously not handicapped and had no plate or sticker. I called the police. They showed up in less than 5 minutes and wrote him a ticket.

I fully understand the disc pain...and yes - I’ve sent in a report to the local police - I know the Chief...and I have photographs of the subject how he was parking - and is the best evidence to have in this situation...don’t have to worry about my word or his word — the pics show everything — the subject actually stated that if I didn’t stop with the pics - “Or else!” — so I stood there and said, “Well. here I am.” I think he was threatening me...geez...the local police are fully aware of this occurring all the time here...

I think the president of the school doesn’t want to say anything since my son is the ONLY disabled child in the school and he want tuition ($$$) more than doing what is right...and allows this to happen without thought...

Just how I view it...

True Story....I go shopping at grocery store and noticed the first two spots closest to the door were reserved for expectant mothers. I parked in the handicapped space #1. As I was getting ready to get out of the car a woman whipped in next to me in the expectant mothers spot, nearly hitting my door.She hopped out and she sure didnt look pregnant. After I got back to my car she came out behind me and I said Congratulations. About how long you been pregnant?? She quickly replied as she dropped into her Beemer, About 45 minutes and drove away. Unintended consequences, I guess.

Yeah, that’s what I mean. The docs will submit the forms for many medical conditions, and the state takes them at their word and issues the permits.....in some states.

A problem around here in MO is many places do NOT keep the the blue markings in good condition. Many times the paint is so faded you cannot see it at all. If the area is not clearly marked, you should talk to the school/facility/business supervisors.

I think that is going to cut down on a lot of folks like the rude lifeguard that I know. From my understanding, a lot of folks get the handicap tag/card because they drive a handicapped person. If they aren’t picking that person up or driving them then park in a regular spot. IMHO.

The system is abused. Lazy healthy people should be hobbled for using HP, and slightly less than healthy people should get slightly more convenient parking and have some pride in themselves. Truly needy people should get what they need to get by, not be elevated to royalty.

The sidewalk “closer” to the school is where this parent should have parked - but he didn’t - this is like the 20th parent who has done this - I’ve said stuff to almost all of them - or the principal has...I confronted this parent this morning and explained to him the law...what the reg’s are on this - and his response was I’m waiting for my daughter...well - wait for for her in an open space or by the sidewalk where every one else parks in the morning to drop off their kid - there are 2 spaces - that’s it...my son is the only disabled child that attends this institution - and the other disabled parents - grandparents - that use these spots as well..it’s just not one parent - but lots of them...it’s more about bringing in tuition to a private Catholic school competing with a major consolidated public school system - so let’s dump on the disabled in lieu of not offending parents of children without disabilities...because we need them to attend and the $$$ they bring in...I think that’s just wrong!

I think that the reason that people feel fine with violating these parking spots is that in some states, the number of handicapped parking spots is disproportionately huge compared to the number of people eligible to use them. When so many sit empty nearly all the time, one should question their existance in such great quantity.

There’s also the issue of people having the handicapped parking sticker/tag that aren’t handicapped. I drove through Rhea county in Tennessee the other day. It seems that half (and I’m not kidding, half) of the vehicles on US 27 had the handicapped parking tag or plate on their vehicle. Either people in that area are extremely disadvantaged or the elected officials like to give them out as favors.

That said, I don’t violate them. I can walk across the parking lot to get to the store when I go.

Since you asked, (and I do not mean this malliciously), I think you may be too sensitive to the issue, but you have been made this way by the existance of the reserved handicapped parking spaces.

Before such legislated parking spaces, I imagine the handicapped had great difficulty in parking, long distances to travel, and even longer if forced to park far away to have space for wheelchair access.

Now, you greatly benefit from what is mostly assured easy access. This can make you resentful when you do not get it. It is human nature.

It is a benefit paid for, however, by the fact that most others are prohibited from using convenient parking. Honest and thoughtful people will gladly pay this small price, but the world is full of a$$holes and it seems we all must endure them.

I unloaded all of this blather on you, just because your question did make me think. It seems that your feelings and the behavior of the violators are simply more of the unintended consequences we seem to always see from feel-good legislation, even something as innocuous as handicapped parking.

I’ve seen some of this in grocery store parking lots. I do one of two things, I go to the service desk with the plate number and ask that said owner move vehicle because he/she’s illegally parked or I just go right ahead and call the local cops, have them roll by and ticket the person. Sometimes I’m tempted to call a tow truck but I don’t know how long it would take for one of those to roll by.
Then there are the ones who park in the “fire lane” to run in for a coffee or to pick up a newspaper, or waiting for someone to come out of the store, etc etc etc. For those I call the cops with the plate number, these for some reason are low priority for cops. I’ve called the fire department and they say it’s parking violation and a cop issue.

I bet you get a kick out of calling 911 when you see a fender bender too. People like you make me sick. You are so busy keeping your nose in everyone elses business you feel a need to tattle every little infraction to authorities.

They're grossly abused, no doubt about it.

My dumbass BIL has one that he uses for convenience. He and I were heading to a shooting range one day so we pulled into a WalMart to get some clays. The jerk promptly pulled into a handicapped spot then pulled out the handicapped tag and hung it on the mirror. I was embarrassed to walk into the store with him...

Maybe God got even with him because he has to use it now since he had a knee replacement a month ago and developed complications........
