New Orleans and U.S. in Standoff on Detentions

NEW ORLEANS — The Orleans Parish sheriff will no longer honor many requests from the federal immigration authorities to detain people who are suspected of being here illegally, making New Orleans one of a growing number of jurisdictions to adopt such a policy and the first to do so in the Deep South.

The policy, articulated in filings that accompanied a legal settlement in federal court, is similar to others that have been instituted since 2011 by Chicago, New York and Washington, several counties and the State of Connecticut.

But in some respects, the policy in New Orleans goes farther than some others, refusing cooperation with federal immigration enforcement at a number of different points. It comes as New Orleans has been wrestling with the Department of Justice as part of a large-scale overhaul of the city’s criminal justice system.

Jennifer J. Rosenbaum, the legal director for the New Orleans Workers’ Center for Racial Justice, which was involved in the settlement, said the city’s policy “very clearly locks ICE out of the jail,” using the acronym for Immigration and Customs Enforcement. “It shows the consensus that has been reached citywide.”

The policy bars the agents from entering certain parts of the jail without a criminal warrant or court order.

I never seen anything like this ice is banned from their jails and must have a criminal warrant or court order.

The policy in New Orleans goes farther than some others, refusing cooperation with federal immigration enforcement at a number of different points...Why doesn't New Orleans just eliminate ice all once and for all. Let them have the burden of taking care of the illegals from small time to big time.Let them do it all.

Typically, the feds have retaliated by having funds for other things, like road improvement, withheld. If they’re not, then New Orleans has help in other areas of the federal government that are preventing this retaliation.

Could it not be said that in a certain way,New Orleans is actually creating their own set of immigration laws ? Are they not bypassing the federal gov by having their polices = laws and making conditions if the feds want to enforce federal immigration laws that the city of ,New Orleans stands really to tell the feds we will refuse to allow you in certain sections of our jails .Is this much like saying our laws a.k,a policies bar ice from entering their jails and we demand you stay far away from our city jails and we have decided that this is the law of the land ? If this subject was about 287g and the cites where this is practiced would we not see protests from illegals,Pastors ,supporters all of them chiming in about how this of how it is the federal gov to pass immigration laws and so shall it will come to be,that we will decide how we will apply our laws to the illeagls aliens currently living in our city . I gather New Orleans is making up their very own set of immigration laws.The feds could careless seeing as how the laws are not being equally applied .What is your opinion of this ?
