Empire State Bldg Owners Sued – Didn’t Allow Muslim Prayers on Observation Deck

The Empire State Building owners, Malkin Properties, just learned they are being sued for $5 million. The lawsuit stems from an incident in which the Muslim plaintiffs claim they were unjustifiably denied their civil rights to pray on someone else’s private property.

Fahad and Amina Tirmizi of Farmingville, NY claim they were “assaulted, battered and forcibly removed” from the observatory in July of 2013. They also assert that it was somehow related to their wardrobe choices of traditional Muslim attire.

Fahad Tirmizi said, “We weren’t doing anything wrong, we just wanted to enjoy the view like everyone else.” He doesn’t state how he was able to admire the view from a head down kneeling position on the floor, or why he forced the security officers to resort to “menacingly” poking him while being told in a loud voice that he was not allowed to pray on the deck.

Sometimes people raise their voices if they are being ignored. This could be particularly true of a security officer trying to instruct someone to move along.

The suit describes the plaintiffs as being “forcibly escorted” down to the lobby and out of the building. That would be consistent with someone refusing to voluntarily comply with their instructions. It is a private building and the deck is for observation, not praying. It is not the Empire State Mosque.

As is common, the intolerance card is being played. Since Muslim is not a race, a different card had to be found. Phil Hines, the Tirmizis’ lawyer, described the hurt feelings and mental anguish of the plaintiffs said the family outing became an experience of intolerance.

Hines said, “To most, the Empire State Building is one of the great landmarks of this city, but for my client and his family, it is a building of ignorance and injustice. A family trip to enjoy the cityscape was cut short after security officials threw them out of the building for exercising their religious beliefs.”

Are they sure that $5 million will make everything okay? While that is a lot of money, how does one decide just how much of a lesson those intolerant bigots need to be taught? Why not just rename the deck after the Tirmizis and then close it in recognition of them for all future visitors to New York?

As minorities go, the Muslims certainly are one of the most demanding of accommodation, preferred status and special considerations. You know the word, “tolerance.”

After this lawsuit, will the next incident be from Muslims who feel that moving to the corner is also an injustice and ignorant? Why not just drop to their knees in front of the elevator door or blocking a fire escape. The security officers would have no choice but to make them move for safety reasons and bingo, it’s payday all over again.

There is no right to be able to pray on someone else's private property.

I call BS on most of this.

It's a set up, plain and simple.

An attempt to change the laws of this country through litigation.

Or maybe non-muslim who was there and felt threatened because the public pathway had been obstructed by someone who was obviously not paying attention to directions by safety personnel (i.e. the guards) could sue the muslims for endangering them? That would need to start with a very loud voice expressing concern for safety and terroristic threatening the muslim prayers obviously represent because of the clear view of the (former) World Trade Center from the Empire State Building.
