( The moment a cop famed for his generosity shot dead a HANDCUFFED bodybuilder - as officials say he will not be charged for killing struggling man on bath salts ) Newly released and shocking security video shows the moment an unarmed and handcuffed bodybuilder was shot dead by an El Paso police officer outside the city jail. The disturbing footage shows former Mr. El Paso, Daniel Saenz, 37, being dragged through the corridors and then outside, after guards refused to admit him because he was harming himself and was bleeding from a head wound. Once outside, the shirtless man struggles against Officer Jose Flores and another guard who lose control of him - causing Flores to reach first for his taser, then stop and instead pull his gun which goes off when the guard knocks his trigger finger.The footage dates from March 8, 2013 and was released by the Texas Attorney General to the El Paso Times who wanted to see the video after a grand jury refused to charge Officer Flores with any crime in February. Indeed, less than six weeks before the violent death of his prisoner, Flores had become something of a media sensation after being caught on camera buying boots and socks for a cold and hungry 83-year-old homeless man.

They admit people all the time under the same circumstances!

Yeppers. The guy was on the ground with his hands handcuffed behind his back flopping around on the ground like a fish high on drugs. He couldn’t seem to get on his feet without assistance. Best to just put him out of his misery, right?

If he was a bodybuilder on bath salts, that changes the equation of the situation quite a bit. Bath salts cause people to go on outrageous streaks of violence and if this guy was still trying to inflict harm while already injured and in cuffs, he might have been strong enough, wild enough, and violent enough to do it.

I’m not a big fan of the modern U.S. police force and what they view as appropriate, but I do want to judge each case on its merits.

I'm trying to imagine calling the police to tell them that I had just killed a man who was handcuffed, because he was in danger of hurting himself.

How do you think that would end for me?

Guy high on bath salts,
cuffed but has already ‘fronted’ a couple of times,
5 previous tazes with no reaction,
guy shoves someone who bumps into cop’s gun hand,
accidental discharge.

I’m goin’ with the grand jury this time.

Saenz was arrested earlier in the day for assaulting a police officer

On the afternoon of March 8 however, 5 feet, 8 inch tall, 217 pound Saenz had been arrested and brought into custody after acting strangely at a local grocery store and mental health treatment facility.

Lesson #1: Don't attract the attention of the Costumed Ones.

When a Jail takes custody of an Inmate , they become responsible for the inmates medical care. If they accepted this bleeding suspect, they may have had to turn around and transport the inmate to a hospital for evaluation or treatment.

With a overtly violent inmate this may require sending two Jailers, who must closely guard the inmate while he remains adjacent to civilian medical personnel.

In order to minimize this burden, the Jails will insist that the Police take the detainee to the hospital
