'Nuclear Terrorism': Hamas Targeting of Dimona Reactor Meets UN Definition

The terrorist group Hamas claimed late Wednesday that it attempted to target Israel's nuclear reactor in the desert town of Dimona by firing three long-range M-75 rockets at the facility. One of the rockets was destroyed in mid-flight by Israel's Iron Dome system, and two fell harmlessly in the rocky Negev. However, merely by targeting the nuclear facility, Hamas has committed nuclear terrorism, according to United Nations treaties.

Article 2 (1) of the International Convention for the Suppression of Acts of Nuclear Terrorism states:

1. Any person commits an offence within the meaning of this Convention if that person unlawfully and intentionally...(b)...uses or damages a nuclear facility in a manner which releases or risks the release of radioactive material: (i) With the intent to cause death or serious bodily injury; or (ii) With the intent to cause substantial damage to property or to the environment; or (iii) With the intent to compel a natural or legal person, an international organization or a State to do or refrain from doing an act.

The treaty defines "nuclear facility" to include civilian nuclear reactors, as well as "Any plant or conveyance being used for the production, storage, processing or transport of radioactive material."(continued)

Well then, Israel has committed nuclear terrorism two times, thus far, and may be about ready to do so a third time (if they go after Iran). I’m not sure how this “will play” ... considering what Israel has done in a useful way in doing what they have done in the past and may do again in the future.

And ... then again ... perhaps someone else might even decide to go after the USA and call it a nuclear terrorist for bombing Japan!

That would be ex post facto. The United Nations came into existence on October 24, 1945. The bombing of Hiroshima and Nagasaki took place on August 6th and August 9th of that year, respectively.

If you were trying someone in a court of law, then you couldn’t convict someone and impose a penalty under the law, in that case ... as you indicate.

But in this case, it’s not a court of law for an individual, and it’s not the same kind of circumstance. It’s more or less a “definition” rather than a law ... and such a definition is used more as propaganda than used for imposing a pre-determined penalty “under the law”. So, the “propaganda usefulness” becomes more valuable than getting some kind of judicial order and/or penalty assessed.

In that way, one could “use it” against the USA ... if one were to “use that definition” as given here in this article.

I’m inclined to totally dismiss what the United Nations says about this.

I haven’t seen where the USA has ever given “military aid” to Hamas. I believe whatever source gave you that particular piece of information ... is wrong.

In talking about aid to the “Palestinian Authority” ... I hope you do realize that Israel and Prime Minister Benjamin Netanyahu wants funding to continue for the Palestinian Authority to enable them to maintain civil order and control over the population of Palestinians.

That’s because Israel does not want its troops directly involved and directly controlling the Palestinian population in a military government in this militarily-controlled area of the territories. Israel and Netanyahu wants the Palestinian Authority to be the “face of the government” and not Jewish troops.

Netanyahu has personally lobbied Congress in the past to NOT cut off aid, when previous bills have come up to do this. Israel - itself - does not want this aid to be cut off.

That's like, really, REALLY, like, BAD!!!!

Look. Hamas is at WAR with Israel. They themselves have said so, many times.

War has a victor, and it has one or more defeated parties.

This constant running on about "UN this" and "UN that", and "Resolution 242" or "Resolution whatever" makes me sick.

Israel has to defeat Hamas in detail, or be defeated herself. That's all.

Hamas is not going to be defeated by dragging UN boogiemen into the picture.

I’ve always been confused about the need to pay a foreign government to keep their people from committing acts of terrorism. Civilized governments publicly punish their own people from acting that way. Paying them is a form of extortion, much like the U.S. has been doing in various countries around the world. But, it’s still giving in to extortion and encourages such acts to continue. “We can’t control them! You’ll have to pay us off to get us to do our jobs!”
