Administrative law is not a lawful form of implementation within the constitution and should not be considered a fourth branch.

There is a constitutionally identified fourth branch.

Our federal government is a creation of the states. When this creation gets out of control, then the states have the right to abolish it or change it.

Besides the three branches of federal government that we are aware of, there exists a fourth branch which most people forget, it is the states. And actually, as mentioned above, this fourth branch has more power and authority than any of othe other three combined.

The constitution is currently not being followed, as identified by this article on illegal and unconstitutional use of administrative law. Therefore we don’t have a constitution.

It is time for the fourth branch to assume it’s proper authority, and alter or abolish the other three.

Liked some of what Ben Carson was saying about changing the structure of government - term limits for judges including the Supreme Court - six year term for President with no running again - eight years for Representatives, but with recall elections every two years if they misbehave - no running again for them either - end the professional political class, and with it the lobbyists, consultants, and crony governmentalists.....

Administrative law is a creation and a tool of the executive branch designed to implement, interpret, and enforce rules and regulations promulgated by government commissions, agencies, bureaus, departments, and other executive branch subdivisions. No way is it a fourth branch.

Some ask how? By removing the organizations like EPA, BLM, etc. Force issues to go back to the House, Senate, and President. Build new EPA, BLM etc and make them advisory only. No regulations can be from these advisory organs but must be presented to members of the House and or Senate for consideration.

The [Federal Trade] Commission promulgates substantive rules of conduct. The Commission then considers whether to authorize investigations into whether the Commission’s rules have been violated. But the agency decision, even before the bona fide Article III tribunal, possesses a very strong presumption of correctness on matters both of fact and of law.

I believe that one way to control the “Fourth Branch” is to require all monies collected by them be turned into the Treasury and spent as determined by Congress.

Yes, in theory we can elect pols to dismantle them.

In practice, the isn’t any personal, electoral reason for politicians to do so.

Since the administrative state relieves elected pols from making contentious decisions that could get them “unelected,” the tendency is to unconstitutionally, yet willingly assign ever more powers from congress to arbitrary bureaucrats.
