Twenty-one states and counting

Question: Let’s say a federal court orders the Obama Administration to release funds to states that don’t comply with Obama’s transgender bathroom nonsense, on the premise that Obama doesn’t have the power to make that a condition for receiving federal funds. Let’s say Obama just doesn’t bother to release the funds.

Who can make him

Good for those states, but I fear the litigation is nothing more than pandering, South Carolina, one of the litigants, would not take up legislation making birth gender the bathroom rule.

All they have to do is ignore Obama’s rulings. He is not Congress. Doesn’t anyone in office know how our government works?

The founders tried to prevent him from becoming President by putting a natural born citizen requirement into the Constitution.

Ignore part, forfeit all.

Usurpers can do anything they want because we would not uphold the Constitution.

While it is good that the states are fighting against Obama’s unconstitutional, PC transgender restroom policy, please consider the following from a related thread.

I suspect that low-information state officials fighting Obama’s policy probably aren’t aware of the following major constitutional problems with it.

The states have not only never delegated to the feds, expressly via the Constitution, the specific power to decide policy for any aspect of INTRAstate schools, but also consider the following.

A previous generation of state sovereignty-respecting justices had clarified, in broad terms, that Congress is prohibited from appropriating taxes in the name of state power issues, basically any issue that Congress cannot justify under its constitutional Article I, Section 8-limited powers, the power to decide policy for intrastate schools not among those powers.

“Congress is not empowered to tax for those purposes which are within the exclusive province of the States.” —Justice John Marshall, Gibbons v. Ogden, 1824.

So the federal funding that lawless Obama is threatening to withhold from schools is arguably state revenues that should never have left the states in the first place.

In other words, as evidenced by the Gibbons excerpt above, the corrupt House has not only been stealing state revenues in the form of unconstitutional taxes, but is continuing to do so.

The states need to eliminate the unconstitutional middleman “helping” the states to manage their revenues.

Also consider that when the Founding States drafted the Constitution, they prohibited the feds and the states from establishing privileged / protected classes which low-information Obama is effectively trying to do by pushing constitutionally unprotected LGBT “rights” imo.

Finally, note that regardless that Congress has always had the constitutional authority to stop Obama’s unconstitutional actions that corrupt Congress has stubbornly refused to do so.

Remember in November !

Patriots need to support Trump by also electing a new, state sovereignty-respecting Congress that will not only work within its constitutional Article I, Section 8-limited powers to support Trump’s vision for making America great again for everybody, but will also put a stop to unconstitutional federal taxes and unconstitutional interference in state affairs.

Note that such a Congress will also probably be willing to fire state sovereignty-ignoring activist justices.

You are absolutely correct.

If your starting premise is false, then everything that follows is invalid.

Pelosi and her cohorts deliberately started with an ineligible pretender, and the neocons consciously played along; there is no leverage against him since they will not go to the cause of the problem.

This emperor has never had a stitch of clothing on his spindly body, but they all trip over themselves to revere him.

(Just the fact that they can treat him as though he is sane and wise when he so often flashes that ghoulish grin like the Arkham Joker nauseates me beyond words.)
