We just had eight years of a president ignoring the law. I’d hoped for better going forward. I expect that President Trump will let this play out in the courts.

I seem to recall that the Obama administration refused to obey a court order--twice-- about stopping drilling in the Gulf of Mexico. Literally ruined the economies of the gulf coast states because they lost so much industry and jobs related to oil drilling. Nothing every happened to him or his administration for defying two court orders.

If Trump were to ignore their ruling, what are they going to do if he refuses to go along with it? Who's going to stop him? Maybe the Congress? But they need a presidential signature on any legislation. Cut funding to the Executive Branch? Not with an overwhelming majority of GOP in the House.

I heard Trump last evening say he would wait for the court's decision. But then he slammed them this morning for legislating from the bench against his lawful order as president by reading the text of the law itself.

I don’t disagree with you, but I believe what I said above is Trump’s way of strong arming them on H1-B and deporting illegals.

Pretty obvious the courts are going to be used as the weapon to stop EVERYTHING, they just filed suit to stop the 2 for 1 swap for regulations
They want to destroy Trumps ability to govern country be damned.

Let's be precise here. Congress "has authority to rule over all things immigration" via Article I Section 8. What they did was delegate to the President the power to temporarily ban entry into the country if national security concerns warrant the action.

What Congress recognizes is that while it has original power regarding immigration and naturalization, the President has original power regarding foreign relations and national defense. Therefore, it was wise to delegate temporary reactionary authority to the President if foreign intelligence suggests he needs to command American security forces in response.

I fear this is all designed to goad President Trump into acting in a manner that will open up Impeachment Proceedings.

And if it would ever get past the House of Representatives, I have no doubt the Senate would vote to convict.

but
yes he not only COULD ignore the PATENTLY UNCONSTITUIONAL and DIRECTLY AGAINST THE LAW (Statutes) judges’ ruling......
but DJT SHOULD CERTAINLY ignore it and enforce his action

since his action is necessary for National Defense (the courts have NO jurisdiction to impede persidential actions lilke this, and a good number of courts have acted accordingly)

Or he could actually follow the law of the land: And take the case to the only federal court with any jurisdiction in the matter, SCOTUS.
Follow the Constitution.

Kennedy has shown he is susceptible to public opinion. The EO was probably dead as soon as Trump went the appeal route. They will be emboldened to use the courts to fight every thing.

Even if Trump gets railroaded he has many other options. For one just write another EO.

There is a little-known and discussed established power that Congress can absolutely, Constitutionally, define a subject that the Judicial is forbidden to "take up." That would include the Supreme Court.
Granted, that is way beyond the nuclear option, but...
Desperate times require desperate measures...

I could think of a subject, but I will leave it to the collective wisdom of Freepers to choose the one most effective order to vote on and apply.

Trolls and the demonstrated stupid need not apply.

Kennedy gave us the monstrosity of Boumediene, which extended habeus and the legal machinery of the Federal courts over combatants held by the military overseas.

Bush, of course, did nothing about this decision.

So McCarthy over at National Review argues that an appeal now would give us a 5-3 decision barring the executive order. That also means would get a 5-4 decision against the order even with Gorsuch in place.

Yep. I’ve always thought he should have pulled a Jackson. But I’m sure he knows there’s a chance everyone from just below cabinet level on down might mutiny anxd obey the court. The swamp is very deep.
