EXCLUSIVE: DOJ Brass Says Comey Struck Insider Immunity Deal With Mueller To Avoid Criminal Charges

A high-ranking Justice Department official believes Special Counsel Robert Mueller has granted a complete get-out-of-jail-free-card deal for disgraced FBI Director James Comey: A coveted immunity deal in exchange for cooperating as a key witness.

“The immunity is a done deal,” a Justice Department source said. “Mueller can do whatever he wants. We (Justice) have no say but after many years working criminal cases I know Comey has been given immunity. You can tell by the way he is acting now and the fact that Mueller has kept us in the dark about his investigation.”

from the regulations:
“the Special Counsel shall exercise, within the scope of his or her jurisdiction, the full power and independent authority to exercise all investigative and prosecutorial functions of any United States Attorney”

To the extent a US Attorney could do an informal immunity letter agreement on his own, then the Special Counsel can do that, and to the extent a US Attorney must get permission for immunity from Main Justice, then presumably the Special Counsel would be under the same regime (i.e., same as a US Attorney).

I wonder though whether DOJ procedures are to have Rosenstein give any immunity approvals since he is the one determined not to have a conflict of interest and is in charge of the Special Counsel.

This news report on the grant of immunity seems rather speculative, however.

By the way I recall reading that Rosenstein actually worked under Mueller at the DOJ in the early 1990s.

For US Attorneys to grant immunity they must get permission from a court.

By the way, there are different types of immunity. See the Criminal Resource part of the manual for the use by US Attorneys of so-called informal immunity letter agreements.

There is a very easy way to deal with this.

Given the Comey -Mueller relationship, the DOJ or White House simply needs to dump enough evidence that makes Comey a potential target of the investigation to force Mueller to withdraw as independent council.

This also forces Mueller's hand with disclosures of any immunity deal.

There is no way Mueller can ethically perform as independent council if Comey is a potential target.

That thought had crossed my mind recently. I can see the whiney beyotch doing that. Why else would he have had to meet with his Daddy before testifying. James Comey, always lookin' out for himself.

Kind of makes you want to laugh at the thought of somebody being charged with criminal obstruction of justice, although it wasn't their intent, and Hillary getting off scott-free because her intent to disclose classified info wasn't criminal. My, my, don't they twist the law to suit their needs.

Webb says immunity is also expected for McCabe.

With Sessions recused, we are screwed.

We are screwed unless the President suspends any immunity deals under consideration. He must do this now, immediately before Rosenstein signs off on it.

No, Mueller cannot do whatever he wants. He is not a prosecutor, only an investigator who turns in a report to the Atty General.
This is not the old special prosecutor law.

This special counsel can have his budget, scope, and direction specified for him. He can be fired.
