Update on Daleiden cases in California and Washington

I want to update you on David Daleiden’s cases in light of the states of emergency in California and Washington State.

We have two court dates on the docket in San Francisco in the next 6 weeks – the first on March 24th and the other on April 17th. We may well have to send our legal team to San Francisco, despite the coronavirus outbreak.

Meanwhile, we’re working hard to continue moving each case forward from here in Chicago.

In the criminal case, we’re filing a motion requesting that a different criminal court Judge review and reverse the legal rulings of Judge Hite, who permitted this case to go forward toward a jury trial, specifically that: 1. The charges should be thrown out, or at least a potential dismissal hearing should be held, to address the extreme, decisive degree of political influence and "collusion” between Planned Parenthood and California Attorney General Kamala Harris and her successor, Xavier Becerra;

2. California's reporter shield law was violated because unpublished materials collected by a citizen journalist, like David, are immune from search and seizure but were misused by prosecutors to secure additional warrants and to bring the charges;

3. The court deemed conversations to qualify as “confidential” despite the fact that they could reasonably be overheard by others not a party to those conversations – like those held in restaurants or crowded hotel convention halls; and

4. The court completely ignored the powerful evidence presented at the hearing that David had reasonable and compelling grounds for believing he would find evidence of violent crimes against persons if he went undercover. And of course, he did find such evidence – namely, recurring incidents of infanticide! Our legal team is doing everything humanly possible to make sure David is never convicted of a crime stemming from his undercover investigation of Planned Parenthood.

In the civil case filed by Planned Parenthood, we expect the “entry of judgment” by Judge Orrick on the $2.25 million verdict any day now. This judgment will include a ruling on the permanent injunction Planned Parenthood requested to prevent David from conducting undercover journalism against them for the rest of his life.

Once that judgment comes down, we have 30 days to file our motion to overturn the verdict and judgment. To help you keep these cases straight, this case went to trial last fall and ended with the jury finding on the side of Planned Parenthood.

In the civil case filed by the National Abortion Federation, we're currently arguing about the scope of discovery we will be allowed to conduct as we head toward another civil trial. This is the case that spawned the “gag order” injunction that prohibits David from releasing the rest of his video evidence.

And in the civil case in Seattle, we’re waiting for the ruling on our second appeal. We already won the first appeal and are hopeful that good news will be forthcoming. This is the case where anonymous abortion providers and fetal body parts researchers filed a class action suit to stop David from accessing public records from the University of Washington about its taxpayer-funded acquisition and nationwide distribution of aborted baby body parts for “research.”

You see, putting aside the legal arguments, the evidence that has already emerged from David’s prosecution represents a gross moral indictment of our 21st century American culture, where human beings are wantonly killed both before as well as after their births. 

These ghastly, macabre truths should be published to the world and taken to heart. But they’re ignored by the mainstream media and covered up, filtered and obscured by judges issuing so-called protective orders, gag order injunctions, complaining witnesses cloaked with anonymity, and sealing from public view of much court testimony and documentary exhibits.

Undercover investigations by law enforcement must be based on the statement of affiants that conventional investigative procedures would not be effective. Standards for civilians are routinely less severe, since they don’t get judged by the same “higher standards” for law enforcement officers. This point alone should be sufficient to tank the case. In a sane world.

I get solicitations from Deladien and his Center for Medical Progress. However, I do not contribute because it seems likely to me that whatever I would contribute will end up in the pockets of Planned Parenthood on account of this judgment.

But supporting the Thomas More Society, which is conducting his legal defense, makes sense. Ways to Support The Thomas More Society

I commend you, and everyone, for doing whatever you feel is best to support David Deladien, his Center for Medical Progress, and/or the Thomas More Society.

I personally contribute cash to David, though I know some funds are indeed going to PPH in the form of "penalty payments" imposed by corrupt judges.

I justify this to myself because I can't put a price on even one life saved of those murdered in the womb. And I know without doubt that David's videos have contributed greatly to the saving of many and have written to him about this. So I contribute to both David and the Thomas More Society. :)
