I read on another thread that the Austin PD said that the rifle had not been fired. Hard to find out the facts.

Doesn’t matter. If it had been pointed at the auto driver, he has sufficient cause to use lethal force in self defence.

according to audio, there were 5 shots then 3 then 1. The driver of the car was released as was the third person involved who shot wildly at the car. It is not disputed that the driver shot 3 times; it is also not disputed that the third shooter fired once. That leaves 5 rounds - the first 5.

It’s self to shoot someone who is menacing - pointing a gun at you and threatening your life, especially when a violent mob blocks your car.
