Missouri Senate Advances Bill to Remove Gun Free Zones

On March 9, 2022, the Missouri House voted to eliminate the gun-free zones which had been placed on Missouri public transportation by the legislature.  Amtrak is excluded. The vote was 101 to 40. Five House members voted present. From  HB 1462 at mo.gov:

Notwithstanding any provision of this chapter or chapter 70, 577,or 578 to the contrary, a person carrying a firearm concealed on or about his or her person who is lawfully in possession of a valid concealed carry permit or endorsement shall not be prohibited or impeded from accessing or using any publicly funded transportation system and shall not be harassed or detained for carrying a concealed firearm on the property, vehicles, or conveyances owned, contracted,or leased by such systems that are accessible to the public. For purposes of this subsection, “publicly funded transportation system “means the property, equipment, rights-of-way, or buildings, whether publicly or privately owned and operated, of an entity that receives public funds and holds itself out to the general public for the transportation of persons. This includes portions of a public transportation system provided through a contract with a private entity but excludes any corporation that provides intercity passenger train service on railroads throughout the United States or any private partnership in which the corporation engages.

I was able to talk to Mirhad Hasanovic, the legislative assistant to Representative Adam Schnelting. Mirhad explained the bill was amended in the House to reform more of Missouri law than the ban on guns in public transportation.

As it was sent to the Senate, the bill reverses the state law that permit holders may not carry in churches without specific permission from the pastor. A ban on carrying in churches by the legislature appears to be a violation of the free exercise of religion

The bill has become a more general gun law reform bill. It will probably pass,*if* it comes up for a vote in the full Senate.

The reality is that as long as criminals are on the loose, there is no such thing as a gun free zone, only unprotected zones.

Interested to know if the NRA has done diddlysquat to help get this passed. And just because certain individuals who did do real work to lobby it happen to have an NRA membership does not mean that the NRA gets to take credit!

A gun-free zone is nothing but a sicko criminal’s “gun free” killing zone.
Look at churches: the coward sickos figured no one would be armed nor would there be any armed push back. They were right. They could easily walk in, shoot the place up and kill a bunch of unarmed, innocent folks without any direct armed pushback to em.
When the church folks started arming up, putting security in place, started shooting back and killing a few of these cowards, the assault on churches seemed to have greatly decreased.
When the moronic cowards figured out that there was a good possibility that they would be shot and killed, they decided it might not be such a “good idea”.
Politician mental capabilities appear to be lower than moronic cowards, but a few are now are beginning to “see the light” so to speak.

The NRA has put out alerts in support of this bill.

Unfortunately, I do not see active support for this bill by a statewide Second Amendment organization in Missouri. A few thousand activists, contacting their senators with emails, would probably put this bill over the top.

RSMO 571.107.
Lists 17 places were a Licensee may not carry concealed.
However, sub section 2 of that statute provides for no criminal violation, only a citation if found to be carrying and the licensee refuses to depart and a peace officer is summoned etc.

So, conceal.

Here is that section in part:
2. Carrying of a concealed firearm in a location specified in subdivisions (1) to (17) of subsection 1 of this section by any individual who holds a concealed carry permit issued pursuant to sections 571.101 to 571.121, or a concealed carry endorsement issued prior to August 28, 2013, shall not be a criminal act but may subject the person to denial to the premises or removal from the premises. If such person refuses to leave the premises and a peace officer is summoned, such person may be issued a citation for an amount not to exceed one hundred dollars for the first offense.

This is one law that I break on a regular basis. If I’m there, it’s no longer a gun free zone.

Good thing the MO legislature back in 2004 saw that through- with exceptions there are no truly “gun free zones” in the state, other than federally placed restrictions.

Of course, a CCW licensee has immunities greater than a “permitless” carrier, in MO.

It is a crime for a permitless carrier to enter in to those places armed.

This bill basically removes the public transport of the state of MO (not federal planes train buses) from the statutes as places that the immuity 571.107 provides does not apply.
