Man Accused Of Sexually Abusing Children Faces Death Penalty Under New Florida Law

A man who was indicted on charges of sexually abusing children is facing what could be Florida’s first death penalty case under its new law.

Joseph Andrew Giampa was charged on Thursday by the Fifth Judicial Circuit State Attorney’s Office with six counts of sexual battery against a child under the age of 12 and three counts of encouraging a child to engage in sexual activity.

According to a news release, State Attorney William Gladson stated that due to the “severity of the crime and its impact on the community,” his office will pursue the death penalty for the alleged crimes.

Let's see if the law passes Constitutional muster. IMO we shouldn't be surprised if it's struck down as “cruel” and/or “unusual”.

Under the age of 12? If this guy is in fact guilty, the death penalty would be most appropriate.

I'm not a lawyer so I don't know how judges would define words like "unusual"....or "cruel" for that matter. Unless I'm mistaken no rapist in this country has been given the DP for many years so I suppose that that could qualify as "unusual".

If this guy gets the DP it's obviously that the case will wind up in the Federal courts.

(Enmund v Florida 458 U.S. 782, 789-793 (1982)) Eliminated the death penalty for all but premeditated murder.

Make it quick. No living in prison for 15 years off of taxpayer dollars with appeal after appeal. A .45 ACP round to the brainpan should suffice and it only costs about fifty cents.

They cannot be rehabilitated.
Kill them.
And those that support them.
This includes prosecutors and judges.

I must object. It is unreasonable to place a person's life in jeopardy just because he is a run of the mill Democrat.

I'm not necessarily saying that that's wrong. IMO an argument can be made for the DP and one can be made against. The argument against is that if the guy can be fried for just molesting or raping you're giving him an incentive to kill the kid.

An earlier post in this thread cites a SCOTUS case in which,it appears,that they ruled that the DP is reserved for murderers...not for "lesser" crimes.

Unfortunately, we have DP inmates still wasting oxygen 30+ years after sentencing. Or just wait for the libs to whine about the DP and let them back out on the streets. Remember what happened last time they did that...
