Can someone is prosecuted for purchasing a weapon ruled illegal by the Assault weapons ban have the conviction overturned when the ban sunsets next week ??

well, since diane feinstein said no one has ever been prosecuted for violating the AWB, I guess the answer technically would have to be 'no'.

There was a similiar case in Colorado where an individual broke an open carry law later voided by a pre-emption law passed before his trial.

He was convicted and jailed.

There were lots of bootleggers behind bars when prohibition
was repealed.

They stayed there.

Now for a case that hadn't reached a verdict yet, you might
get a jury nullification, but don't count on it.

And for one that hadn't even gone to trial, the DA might
decide that there more productive uses of the criminal
justice system, or not.

What is the scenario, by the way. The SWB didn't cause
the proscribed items to vanish, it just stopped the
production of new ones, and drove up prices of old ones.
