At the risk of alienating the roughly 1/3 of FReepers who, judging by the FR poll, support the Miers nomination, I believe its withdrawal has now become a question of when, not whether.
The final nail was probably the John Fund article in this morning's WSJ which strongly suggests that if hearings proceed, some very messy matters regarding the Texas Lottery and W's National Guard service will be dredged up. Here's a link to the Fund column:

Note also that, after staying above the fray, the influential Wall Street Journal editorial today calls the Miers nomination a "mistake."
So with this as preface, and again, with apologies in advance to FReepers who might be outraged at the exercise, I am starting this pool to predict when the announcement will come - be it from the WH or from Ms. Miers herself - that the nomination is being withdrawn.
I'll start the ball rolling by putting in my pick at the early end of the spectrum:
Monday, October 24th, 5 PM.
Have at it!
I'm taking the liberty of pinging this to the Today Show ping list.
Won't Happen............
She's confirmed on the Friday before the Thanksgiving recess.
I assure you I will not suffer from withdrawl when this topic is history. ;)
Monday, Oct 31, at 8:00 a.m.
We also need a pool for who'll be the next candidate:
Tuesday 9 AM EST. Replacement: Judge Luttig (I can dream can't I?)
I see that my theory is not meeting with universal support ;-)
The least you could do is offer some useless plastic object as a prize to the winner. Wal-Mart has aisles full of them.
Help stamp out internet gambling. :-)
That's the 25th. BTW.
She will be confirmed by Thanksgiving.
Noted. I'll give the pool some time, then post a list of all entries!
October 27 1PM Eastern
She's going to have to be "insulted" by Fat Teddy and the Plagierizer in confirmation hearings before she "backs out".
It's all part of the plan.
Noted.
If the Senate doesn't do so, will W do a recess appointment?
I don't agree with the nomination, but I don't believe she will be withdrawn.
alotta expert bullshit.
