Tammy Bruce's Constitutional Ignorance: Disappointed Alito Supports Abortion Notification

Tammy Bruce is a self-styled maverick. She describes herself as a "an openly gay, pro-choice, gun owning, pro-death penalty, voted-for-President Bush progressive feminist."

But in her just-completed interview on Fox News, she revealed a profound ignorance of the way our constitutional system works.

Speaking of Alito's vote to uphold a law requiring women to notify their husbands of their intent to have an abortion, Bruce said:

"I'm disappointed that Alito thought this was an appropriate area for legislation."

"Appropriate" has nothing to do with it.

A strict constructionist might have thought it was a very foolish piece of legislation. But the only issue that a judge should take into account is whether the statute violates the constitution. If it doesn't, then he has no basis to overturn it, regardless of whether he personally thinks such legislation is advisable.

Democrat Governor Bob Casey signed the Pennsylvania Abortion Control Act into law.

I can't wait for the left to attempt to argue that Alito is too extreme because he concluded that a Democrat Governor did not act in an unconstitutional fashion.

Marriage is a contract. Notification could be defended as being part of the contract.

Sheesh she was against Harriet Miers also.

Kinda of like farah and coulter in their naysaying, but without the outright animus.

Did Tammy already read this thread? She came back on Fox and said something along the lines that Alito looked good despite the reservations she expressed.

Tammy....the Father/husband is REQUIRED BY LAW under punishment in Jail to provide for the child for 18 YEARS.....the mother ONLY has to provide for the child for 9 MONTHS......there is NO LAW that requires a mother to pay for anything!!! You betcha the Father/husband has something to say about the baby since he BY LAW MUST provide MONEY for 18 YEARS!!!

The baby is the sole property of the woman...until there are bills to be paid. The father's sperm does nothing in the feminist's view but assure that support checks come in.

Exactly. A judge is NOT a super-legislator. A judge isn't supposed to decide what a law should be but how the law should be read. If the law's wrong, it should be up to the elected representatives of the people to change or repeal it.

I forgot to add that if the father/Husband is not t have any say in the abortion, then the FORCED PAYMENT OF MONEY FOR 18 YEARS MUST BE STOPPED ALSO!!

If it isn't an appropriate area for legislative legislation, why would it be appropriate area for judicial legislation?
