Baby Huey Tries To Steal A Radio Station.

Now, the full story just as it appeared on Wednesday, September 11th, 2002...

If you're one of the many "regulars" who had spent a great deal of time getting to know us, either through our web site or our actual on-air signal, you've probably noticed that our world-wide presence has been almost non-existent for the past few months. Well, that portion of our ordeal is now over. Here is how it all came about, originally:

For some time, after arriving here, we kept receiving strange "warnings" from area residents (who would normally stand to gain absolutely nothing by issuing such warnings) that Shamrock Economic Development Corporation was preparing to "use" us as a means of supplying valuable equipment and labor for keeping (then) KRMN-FM on the air while seeking another cash buyer that would bail them out of a bad loan situation that they never were supposed to have gotten themselves in to begin with.

According to these "tipsters", Shamrock EDC would use us to replenish supplies and equipment involved in operating the station and, upon finding an "acceptable buyer" (you can read this as "friend of EDC"), forcibly chase us out of the building while illegally retaining possession of our equipment and anything else they wanted to keep.

I, personally, sat through several months of "showings" in which David Rushing would escort "potential buyers" through the building and give a great sales pitch during the "tour". Not once did I ever hear any mention of the fact that the equipment in the building was owned by myself or my business. It was always presented as, "And, look at all of this great equipment that you'll get with this station! The equipment alone is worth more than the pay-off on the loan! And, it'll all be yours!"

The final straw was a meeting that I had with both David Rushing and a person whom I had never met. The man's name was John Mann. David Rushing had already told me that he was "the man we use when we really want to take something from somebody whether it's ours to do so or not. John can get anything from anybody and he doesn't care how he does it because he knows the law and knows how to get around it when it helps us. Besides, we pay him with taxpayer money and he knows that will never run out." John Mann confirmed each of these claims at that meeting and seemed to rather enjoy gloating about the manner in which both he and David had "tapped into taxpayer money that won't ever run out so, it's just not worth fighting Shamrock EDC".

Well, after about 30 minutes of John Mann's haranguing me and ordering me, several times, to simply give EDC the station license, I had already decided that the "tipsters" who were warning about just such behavior must be right! John Mann leaves absolutely no room for honesty and has no regard at all for "right" or "wrong". Unfortunately for himself and his clients (in this instance), he had no idea what he was talking about...

I listened to David and John try to convince me that I "really don't want to own that radio station" and how I'd be much better off if I'd "sign over the license to EDC" so they could "locate a buyer that might let you (meaning me) stay on as an employee". They went on to explain that they had a friend who had worked at Shamrock's old KBYP-AM and that the man wanted to move back into the area and purchase the station and that he would be a better owner and they would prefer to see this happen because he was an "old friend" and that there would be no room for debate on this decision. (This would've made sense, had the foreclosure on the real property been anywhere near completion and/or the real property associated with the station being put up for bids. But, this was not to be the case. Their friend wants it and that's the way it shall be. Case closed!) Before this meeting concluded, I was "invited" (ordered) to attend an "emergency meeting" of the EDC that was called for a day or two later.

Surprisingly enough, at about this time, someone elected to steal almost 100% of our backup transmission system. At the time, this seemed to be an unrelated matter but, e-mailed messages from this person and an alarming tendency for EDC to insist that "He really says he didn't steal anything and has receipts for everything he took" (even though we still have the real receipts and, through our receipts, the equipment can be traced back to the manufacturer) are now indicating that there may have been a certain amount of "conspratorial coordination" of these crimes between himself and at least one EDC board member.

I was not allowed into the "emergency meeting" until some 10 minutes after it was called to order (actually, I was asked to leave and to "come back in about 10 minutes because there's something we have to do before we can let you in") and, when I was finally allowed into the meeting room, the only resulting discussion centered on how certain John Mann was that our FCC transfer of control "just won't fly". I was also suddenly finding myself treated in a much more "demeaning" and "condescending" manner than I had ever been treated in Shamrock in the past. Suddenly, in the eye of these "fine folks", I had become what they refer to as a "low-life" just like everyone else who wasn't actually a part of there little "circle of power" and was finding out exactly what it's like to have been found guilty of thinking about the good of the community before thinking about lining their pockets and this just won't be acceptable behavior!!!

I reminded these fine folks that fully 95% of the equipment (including the current transmitter) responsible for keeping KBKH-FM on the air is 100% owned by MonsterFM.com/Broadcast Services and that no actual party to KBKH-FM (previous ownership and/or lien holders) has any claim to this equipment in any way, shape or form. Their portion of the "station" (as it existed at that time and as they held a lien to it) existed primarily as a large building (nice as it was) and two old personal computers (200 MHz. Pentiums without anything more special than a soundblaster 16 and a 4 gigabyte hard drive) and several desks!

I was excused to go and "handle station business" and was ordered to provide some very detailed "financial reports" and "financial projections".

So, we set about moving vital systems to our home on Texas Street and erected a temporary antenna system at that address. We filed for an emergency STA (Special Temporary Authority) with the FCC and the entire operation was moved within just a few days time. We were so very careful to not even remove an ink pen that belonged in the old building. In fact, we left a great deal of equipment in the building that was mostly unrelated to the operation of the station and could not have possibly been their property before we arrived and brought in our equipment. We also left a great deal of our personal belongings and children's belongings behind just to see if these "fine folks" actually would stoop to a level at which they would attempt the outright theft that we were warned of. Now, we will eventually get to sit back and see how they claim exclusively AM equipment was used in the operation of an FM station! (As those who are "technically inclined" will be able to attest, it can't be used in that manner!)

This left us sitting in the old building at 201 North Main Street just waiting to either prove or disprove our theory. (OK, so I'm a person who just can't seem to believe a person is capable of such heinous acts and such a callous attitude. I simply must actually see such cowardly behavior before I can condemn a person for behaving in such a brazenly stupid manner.) We sat there for almost a week waiting to see what would happen and, just as promised and predicted, Shamrock EDC didn't fail to provide the entertainment.

Just as predicted, on July 29th, shortly after noon, David Rushing (EDC Director), Jerry Bob Jernigan (County Constable) and Tom Velasquez (local "Pretty Boy" grocery store owner - for lack of a better description) burst in, unannounced and without any small, polite form of entry. They were there and they wanted it known that they were in charge!

David Rushing flashed a piece of paper (he referred to it as a "Texas 15 Minute Eviction) that had been signed by himself and notarized by someone that I assumed to be his secretary. There was no judge's signature or other "official" documentation present.

Jerry Bob Jernigan's first announcement was that, "Ya'll got just a few minutes ta git ya personal stuff and git out! If ya touch any 'quipment that's got anything ta do with the operation of the station, ya gonna git hurt!" (This probably would've seemed like a joke, had he not constantly kept his hand on his gun...)

We were forced to place most of our belongings in trash bags and place the bags in the center of the kitchen/dining area. Of these trash bags, we were allowed to remove a small percentage that contained anything that did not look remotely like it might've been electronic in nature.

All the while, Jerry Bob Jernigan kept his hand always near that firearm that he's so proud to hide behind and kept the constant rant up about how he "is the LAW around here and anything I tell any judge will be believed over anything y'all tell him" as a constant threat to keep us whipped into pitiful submission. (Of course, we didn't tell them that they were busily stealing property that had absolutely nothing to do with the operation of our station - it had been legally ours to operate as we saw fit since I arrived, in February but, under the hopes of making an equitable purchase agreement with EDC, I knew that they'd never deal with me if they knew I already had control of the license).

After a great deal of our remaining property was placed in trash bags and piled up in the middle of the floor, Police Chief Joe Daniels was called in to photograph "the mess" that was left behind. Toby Brooks followed up with the now (in)famous pictures that (dis)graced the back of his little newspaper about a week later.

I did manage to get the audio and video (not yet approved for release by our attorney) recordings made by the internal security system by removing the entire recorder! This was the only way to get the evidence of what these (in my opinion) idiots had done because they were showing absolutely no regard for property laws or any other kind of law! In fact, our children were becoming more and more a concern to us because they kept asking, "Is that bad man with a gun going to kill us?" And, sadly enough, Jerry Bob Jernigan's attitude and behavior, at that particular time, did indeed indicate that he was enjoying himself immensely and would probably have liked nothing better! (David and Jerry Bob insisted that the security system MUST have been there before I arrived but, I knew that I had purchased it just three weeks earlier and, even better, had purchased it with a credit card so that there definitely is proof of these facts. I'd better be glad, too! Despite both my locating and producing credit card receipts proving my ownership and an October 3rd court order for the return of our properties, this security system is still being illegally held by these "fine folks" even to this day!)

Now, keep in mind the fact that I had just removed the recordings of what was going on and the fact that everything relating to the actual operation of the radio station (that was clearly owned by us) had been removed almost a week earlier. What did David Rushing, Jerry Bob Jernigan and Tom Velasquez accomplish by so brazenly stealing (and gloating about doing so, the entire time) the remaining property that was not in any way related to the operation of the radio station? They proved (to us, anyway) that they have absolutely no regard for the health, happiness and/or property rights of others. I have absolutely no doubts in my mind that, if they had thought it would "support their cause", they would've wounded or even killed either myself, my wife or either of our two little girls. Of this fact, there is absolutely no doubt in my mind, at all.

These "fine folks" had proven themselves to be just as criminal in nature as we had been told and then some. They had proven that, aside from their own concerns, the welfare of others meant very little, if anything at all, to them. We all knew this as we drove away

I just checked the FCC database. Terry Hammond is the holder of the licence for KBKH-FM. He has held the licence since April 24, 2003. As long as he keeps his nose clean with the FCC, there is no much that anybody can do to get the radio station away from him

I have done some research on this case. The FCC issued a NEW license on April 24, 2003. Mr. Hammond has legally leased and owned the station since February of 2002. I also don't think it is so much a matter of the worry of someone taking away the radio station as it is a matter of the two years in prison and the loss of the station license over being accused of stealing his own money (convicted felons cannot hold a license and this one will be revoked). By the way, the indictment was sought by a district attorney who is now serving time in a federal prison for selling drugs through his office in the courthouse and this radio station reported the story before any others. This looks like revenge by a corrupt local government to me!

This guy spammed a radio-interest board with this stuff and was banned from posting. Just about every board had a post.

too." Good luck with your cause, Mr. Hammond, but the rules
of that board clearly prohibit cross-posting and spam.

I happen to know, first-hand, that this was not posted by Mr. Hammond. The posts were made by one of his loyal friends and supporters. I can admire the guy for that kind of loyalty. We all need friends who would be nearly so willing to help. Spam? Maybe but, is it really that much more difficult to merely breeze by the posts with the understanding that extenuating circumstances sometimes bring forth acts of extreme loyalty for some people who truly value their friends? Personlly, I'm intrigued by the situation as I can easily see that just such a travesty of justice actually can happen anywhere if this case is allowed to set a precedent. We all really do need to look into this matter to keep this practise from becoming acceptable lest we all find that we owe debts entered into by others. Imagine the windfall to the creditors should this set a precedent and just anyone claiming "they owe me" can walk into the nearest Clear-Channel cluster and take all that they "feel" they are owed without any due process of law!

Mr. Hammond leaves out vital parts of his story to you guys like the former owner that signed over the license had sold his part of the station ownership to other people 3 years prior. The so called lease did not appear until after the sheriff's dept began investigating Mr. Hammond. Little things that Hammond forgot to tell everyone.But the jury was able to see the whole story and all the documentation. Hammond appealed his conviction and lost the appeal. Then he took the case to the Texas Court of Criminal Appeals(Texas Supreme Court) and lost there also. There is always 2 sides to every story.

Mr. Hammond leaves out vital parts of his story to you guys like the former owner that signed over the license had sold his part of the station ownership to other people 3 years prior. The so called lease did not appear until after the sheriff's dept began investigating Mr. Hammond. Little things that Hammond forgot to tell everyone.But the jury was able to see the whole story and all the documentation. Hammond appealed his conviction and lost the appeal. Then he took the case to the Texas Court of Criminal Appeals(Texas Supreme Court) and lost there also. There is always 2 sides to every story.

And, the real side of this story is that Mr. Hammond did NOT serve any 2 years in a prison (much to the chagrin of the drug-dealing DA and the liar’s club EDB director). He is currently sitting comfortably at home awaiting federal actions against all of the criminals involved in this matter. I know. I am here! It’s people like David Rushing and Lynn Switzer that give small-town America a bad name. Stick to thievery and prostitution. It is more befitting you.

All is not as it seems, David (”rusdot” is an acronym derived from David’s surname - if he even knows what that is - and his wife’s name: “Dottie”).

It’s not at all over. The writ was granted due to “an unconstitutional court ruling” that was written and sought by the replacement DA (so bad that she had to be appointed and NOT elected as a means of showing how popular she is) who is every bit as involved in crime and corruption as her drug using and dealing predecessor.

She’ll end up in a cell with Rick Roach and YOU as cell-mates. That is the reason she’s been openly admitting (at her weekly poker game) that she “really knows Mr. Hammond isn’t guilty of any crime but, to back-off now is to risk further investigation of the office of the district attorney and that would be really embarrassing.”

People like her (and YOU) are the same kind of people our troops are fighting against in Iraq. Same morals, same values. Maybe Bush needs to send in troops to liberate texas?

Here is a valid summary of what these criminally deranged lunatics in Shamrock Texas have done:

If YOUR bank (or ANY bank) loaned ME money and listed YOUR car as collateral to secure the note, they could NOT take YOUR car if I defaulted…

These people did exactly that. And, they have gotten away with it so far.

I guess the moral of the story is that, even if something’s done completely legally and someone else wants it, they CAN take anything at any time for no reason at all.

I just thought that you might get a laugh out of the crimes these people have committed with the assistance of Lynn Switzer's brand of “I do whatever I want to do and see whatever I want to see” justice.

If you've been following this topic, you might be interested in seeing the document that I’ve linked to below. It’s a couple of years old and the lawyers have had it all along. Honest people have only just now managed to get an original copy and it SHOULD have been very important but, for whatever reason, nobody wanted to use it in the criminal case being discussed here in which an honest and innocent person was “convicted” of stealing from a business that he very clearly owned with full rights to his receivables. Of course, we're all still being told that “Texas doesn’t recognize that ‘out of state stuff’...

Texas is a throwback to the dark ages. Surprisingly enough, these people seem to be proud of their crimes. Why not? It works for them!
