Nifong Wants Addresses, Key-Card Data In Duke Lacrosse Case

District Attorney Mike Nifong is accused of going on a "fishing expedition" in the Duke lacrosse rape investigation.

Nifong issued two subpoenas asking Duke University to hand over the home addresses for all of the lacrosse players as well as two other people.

Nifong also wants the information from the students' key cards that track their movements on campus.

2 days later Kim is arrested for probation violation.

Was nothing but a fabricated racial division ploy by the Durham DA to garner the black community's vote in the primary back in May. Nifong figured he couldn't lose either way by playing this accusation up to gain notoriety for the primary election.

He has no evidence to prosecute, never did, doesn't care, either. With the past history of the accuser and her accomplice, he knew that playing the courageous DA for the poor black woman would be a win win for the primary election. If this was a routine BS false report, the accuser would be in jail for filing a false police report. However, she won't go to jail because he won't prosecute her. I figure the accuser decided to see if she could do a shake down with the LX team/university for an 'undisclosed settlement' in light of that quite a few players were most likely drunk and a few racial slurs did come out and she got mad.

Nifong has now realized with the money behind the defense for the caliber of lawyers involved, he has bit off more than he can chew and his professional career and license to practice law is now on the line, 'cause the parents of the players will not settle for anything less (as well as many of the university's board of directors).

Where's Jesse's Rainbow Rogues suppose to be helping for the shakedown? They're not stupid, they now know what went down and have quickly bowed out, otherwise, Jesse would be on TV running his yap.

I don't know about NC, but in Texas District Attorneys do not have the power to issue subpoenas. So take this with a grain of salt.

You're right. We've discussed endlessly what would be lost or not lost if the cell phone battery were to go dead. Depending on the model, the address book could be in volatile memory (lost with dead battery) or nonvolatile memory (not lost with dead battery).

I would imagine that even if the battery is dead there is something in the nonvolatile memory that is valuable to the defense and the address book is a good example.

In regard to Nifong subpoenaing the records.

Wonder if the investigative "brain trust" is thinking that the player's away from each other and relaxing during the summer break will be more likely to talk? Is that the reason for the home addresses being sought so late in the game?
More visits and questions without lawyers present? Remember, the lawyers are Durham based. If they are visited by investigators in New York or Maryland, their lawyers are going to be 300 miles away or more.

As for the key card data from Duke, how bad does that look that 3 months AFTER the party, Nifong is looking for this information? More evidence that Nifong doesn't know who was at the party and who wasn't? More evidence that Nifong is STILL trying to figure out what happened?

Or was the University Key-Card data going to be used to squeeze some kids in Connecticutt without their lawyers? Show the kid the data showing that he didn't come home that night, tell him he's the prime suspect and they know where he was and we found incriminating evidence at stated location, evidence tying you to the crime. Unless you tell us everything and agree to testify against Reade and Colin,
you're going behind bars - and not just for the summer.

She told the nurse she was not choked, yet Nifong got on National TV and demonstrated this (as consistent with her story).

He also used felonious strangulation at 610 N. Buchanan as justification for an early search warrant.

This case becomes a greater abuse of power with each passing day.

I think Nifong is still trying to figure out who was there. He may be thinking he can use it to prove the time stamps on the photos were doctored, or at least make it appear that they were.

I think you're giving him too much credit. I think he's looking for those who don't have a key card time alibi, and then only they will be included in the next photo lineup.

The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the ******* injuries mentioned in the rape kit report.

The defense attorney also takes issue with the rape examination itself, pointing out that the nurse who assisted in the exam was in training. Osborn says the only evidence of physical trauma the nurse could find was a scratch on the accuser's knee and a small cut on her heel, which was not bleeding.

My mouth literally dropped open when I read that report. She wasn't drunk, she was drunk, she didn't have alcohol, but she had beer..wtf!?!? I wish I could see Georgia Ghastly screech about this!

I wonder if Roberts knows she participated in the assault.. amazing...

The accuser told the nurse that Roberts assisted players in the alleged sexual assault and that the second dancer stole her money and property, the motion said.

The WTVD story certainly was more thorough than the original link in the first posting! I wonder if Roberts was aware before today of the fact that the accuser is also accusing HER of assisting players in the alleged sexual assault and that the she stole her money and property?

If she didn't know about that little tidbit before, maybe things will get a little more interesting in her next interview!
