Lacrosse Scandal: The Duke Accuser—New Credibility Questions (Newsweek)

Early in the Duke lacrosse rape investigation, Durham District Attorney Mike Nifong, who was in a close race to keep his job, spoke about the physical and emotional trauma the alleged victim had suffered at the hands of the players. A police affidavit stated that her medical records revealed the victim had "injuries consistent with being raped and sexually assaulted vaginally and anally." But according to a motion filed by defense attorneys last week, no such physical trauma was found during her exam at Duke hospital. Quoting from the report, which was submitted to the court under seal, the motion states that the nurse—who was in training—examined the woman's entire pelvic region and noted only diffuse swelling of the vaginal walls, a condition explainable by consensual sexual activity.

Police documents indicate that the accuser had in fact engaged in such activity in the days leading up to the incident. The accuser told police that she'd had sex with her boyfriend a week before. She added that she'd also performed using a vibrator in front of a couple. (Though the timing of this incident is not specific, the clear implication is that it had happened near the time of the lacrosse party.) And, according to defense attorneys, the boyfriend's seminal fluid was found in her, suggesting she'd also had sex with him within 72 hours. Jarriel Johnson, who identified himself as the woman's driver, told police in a statement that in addition to sleeping with the accuser himself a week prior to the party, he'd taken her to several appointments at hotels in the days before.

This should provide Hannity & Colmes with at least another month of Duke Lacrosse 20 minute "updates." That show has become so pathetic that I've switched to Scarborough.

For FNC Duke Lacrosse has become this year's Natilee Holloway.

Same here. This woman should pay for what she's done to these students. (Not to mention the harm she's done to women in the future who might actually be raped--and not believed because this idiot cried wolf.)

Nicolas Kristof has an oped piece on the Durham case in the NYT today comparing the Duke players to the Scottsboro Boys.

Any hardy souls (hardy indeed) with access to the NYT select? I certainly wouldn't pay Pinch Sultzberg any money.

If this case goes to court,Nifong will be laughed out of the courthouse.The tragedy is that the defendants and their parents have probably spent many thousands of dollars to defend themselves.I believe some states will reimburse a defendant some of the costs incurred if found not guilty.

what's sad is a coach resigned, a season cancelled and 3 guys have their names smeared for life..a university taking action on a baseless accusation..they were considered guilty until proven innocent, not exactly the way things are supposed to work.

I've tried to keep an open mind about this and not decide anything, however, the more I read about this case, the more it appears this "Precious dancer thing" had $$ on her mind..

in the history of the world, there's been no such thing as a successful liar..too many stories to try and keep straight..

She could never have done anything to anybody if the D.A. had not been a politically-motivated whore.

Nifong needs to spend time behind bars for prosecutor misconduct.

The county/state (depends on NC law) will pay millions to players, parents, coach, etc.

Secondly, can we now stop calling her a "dancer" and begin to refer to her as what she is, a "prostitute." No need to be pejorative with 'whore" or "ho" but "prostitute" is certainly applicable.

As I understand it now, this whole business of "injuries consistent with being raped and sexually assaulted vaginally and anally," appears now to be a figment of some investigator's imagination. According to the article, the medical report did not say that! This is hugh and series!

Right, this is only hurting real victims of future rapes. Gloria Allred seems to be coming around. The rest of the women in the so called movement need to come out and speak out against this sham of a case too. This "striper" isn't going to help any womens causes.

A article I read the other day said the ones that haven't been indited have already spent 14,000 dollars protecting themselves.
