The laughter has definitely gone out of Joe Piscopo's marriage now that the former "Saturday Night Live" star and wife Kimberly are divorcing.
A Hunterdon County (N.J.) Family Court judge issued temporary restraining orders to both spouses on Monday after they each alleged domestic abuse.
Kimberly filed for divorce on July 10, but the couple tried to continue living together in the Piscopo mansion. That is, until last weekend, when, after one particularly ugly scene, Kimberly sought an emergency order of protection.
After a North Hunterdon Municipal Court judge ruled the Vegas-bound actor was not an immediate threat, Joe got the jump on Kimberly by showing up bright and early at Family Court to give his side of the story. Judge Roger Mahon granted the funnyman not only a restraining order, but temporary custody of their kids and possession of their house.
Spies say Joe was leaving the court when he wordlessly passed Kimberly, on her way to get her own order.
Kimberly's lawyer Jane Ellen Doran tells us, "We believe the allegations set forth in Mr. Piscopo's recent domestic-violence complaint will be shown to be false, retaliatory and motivated by a desire to gain unfair advantage in the pending divorce action."
One ally of Kimberly called it "absurd" that the brawny 6-foot-1 bodybuilder should claim he was abused by the 5-foot-5 model. "It doesn't take a very large person to spit and use foul language," argued Joe's lawyer Eric Spevak. "Mr. Piscopo's filing was motivated by nothing more than the safety of his children, which is why the judge granted him temporary custody."
Sources say Mahon also instructed Kimberly's father to leave the couple's house. Kimberly has told friends her dad came up from Florida to "protect" her.
Joe met Kimberly when she worked as a nanny to his son, Joey, from his marriage to his first wife, Nancy.
Seventeen years later, after Joe and Nancy split, Joe and Kim wed in a 1997 ceremony, with Joey serving as his dad's best man. Joe and Kim have three children: Alexandra, Michael and Olivia.
"Joe wants to work this out," said Spevak. "He's done everything possible. But after awhile you can only bend so far."

CNN anchor Kyra Phillips was caught with her skirt down Tuesday when she left her microphone on during a trip to the ladies room.
The mortifying episode came when Phillips stepped away from her desk during coverage of President Bush's Hurricane Katrina anniversary speech. Viewers saw Dubya's lips moving, but they heard Phillips pulling down a zipper and making girl talk with another woman in the rest room.
"I have the most handsome man," Phillips gushed. "Just a really passionate, great, great human being. And they exist! They are hard to find, but they are out there."
Phillips' sister-in-law didn't get such positive treatment.
"I've gotta be protective of (my brother)," she was heard saying as she washed her hands. "He's married, three kids, but his wife is just a control freak!"
The mishap had CNN producers cringing.
"I hope it doesn't look like Kyra made a mistake, because it was actually a technical malfunction, not a human error," an insider told The New York Daily News' Ken Bazinet.
The network later said in a statement: "CNN experienced audio difficulties during the president's speech today in New Orleans. We apologize to our viewers and the president for the disruption."
Doesn't the sister-in-law deserve an apology, too?

I am surprised this 'kidnapping' posing as a 'relationship' lasted as long as it did. As soon as I saw this, all I could think of is when Piscopo went on the old Howard Stern TV show with his then 20 year old conquest, fawning over how in love they were, etc. Stern told him flat out: You dumped your wife and family for a hot young baby-sitter, you're a mess. He (piscopo) even wrote a song about her where he sang and played the piano (at least tried to). It was horrible. Stern used to play it all the time in the early 90's. He never let Joe live it down.
Reason I posted this was I was amazed that Joe beat her in court by showing up early. He turned the tables on her. Looks like she has to leave the house and children, not him. I'll bet sly ol' Joe has a very good prenuptial agreement that's driving Kimberly mad

I thought he was a homeless person by now.

Those who dump first wives for "trophy wives" deserve whatever they get.
