Duke LAX Defense Attorneys Meet with Prosecutors

(02/07/07 -- DURHAM) - The defense attorneys for the three charged players in the Duke Lacrosse case met for several hours with special prosecutors James Coman and Mary Winstead Wednesday.

Defense attorneys declined to comment about the meeting. But sources close to the case tell Eyewitness News that this was the first opportunity the defense has had to make its case for why the charges against their clients should be dropped.

This is ridiculous.

In California the state has 60 days from indictment to start a trial, otherwise charges must be dropped. (That's called a 'speedy trial', in line with the requirements of the 6th amendment).

In this case, the special prosecutors are claiming they need 120 days to examine 6 boxes of documents; after Nifong had 250 days to prepare his case.

Having moved here from California, I can attest to the fact that "North Carolina is no California" when it comes to justice. Here, the old stereotype "redneck sheriff" still lives, but he may be in the form of a cop, a DA, an Attorney General or even a Governor.

In fairness, the State's Attorneys would be crazy to use anything Nifong prepared, so they're pretty much starting from scratch.

Having this hang over the families is torture. False evidence was presented against the players (they were framed deliberately). This case should have been dismissed long ago and the FA and Nifong charged. They, not these three young men, should be facing the a possible trial.
