New Hampshire authorities said yesterday that they will not press charges against a former Marine who stepped into a deadly shooting and killed a 24-year-old high school dropout who had moments earlier fatally shot a police officer.

The former Marine, Gregory W. Floyd, 49, was driving with his son along Route 116 in Franconia on Friday night when he saw Liko Kenney, 24, shoot Franconia Police Corporal Bruce McKay, 48, four times in the torso. After Kenney drove his Toyota Celica over McKay as the officer lay on the ground, Floyd grabbed the officer's service weapon and shot and killed Kenney. . . .

The elder Floyd drove his Tahoe into a spot between McKay and Kenney as a shield and told his son, who is in his late teens, to run to the officer's cruiser and radio for help.

The elder Floyd picked up McKay's gun from the ground and ordered Kenney to drop his weapon. Kenney refused, and Floyd saw Kenney appear to be reloading, Conte said. Floyd then shot and killed Kenney, Conte said. . . .

New Hampshire's attorney general, Kelly A. Ayotte, said Floyd will not face charges because he was justified in using deadly force.

Note the headline makes it sound like there was a feud between Greg and the perp Kenny.

If you took the time to read the article, there was in fact, a feud between both men.

Kenny was convicted of assaulting a police officer in 2003. Want to guess who the police officer was? When Kenny saw that Greg pulled him over. He requested a different officer to cite him. Greg refused and the situation escalated from there...

The perp was a spoiled brat, who lived in the fast lane, who had run ins with the police frequently.Kenny was a wayward druggie.

Source? Or do you know about this based on personal experience? Or did you pull this information out of your ass?

The greatest fear among those in our so called legal system is that people may solve their problems without the intervention of prosecutors, judges and defense attorneys. All three could be put out of business. Because of the simple solution in this case the “legal system” has been deprived of big bucks and much publicity.

Kinda scary. A guy I work with was a passenger in a car that was run off the road on the night of May 2 on route 116. He was bumped from behind by another car and the driver of the car he was in sped up. He was bumped again and lost control, crashing into a sparsely wooded yard. (As they say on Thomas and Friends, "Luckily, no one was hurt", badly. Bruises.)

The homeowner was nice about it. He called the cops and told them that a black Audi had been in the habit of speeding up and down RT 116. The State cops took an interest and took paint scrapings off the wrecked car. The cops figured that the perp would become involved in another accident sooner or later. I suspect that this case will be elevated in the light of developments.

No way to know if they are related, but it is provocative.

FWIW, Kenney's uncle was interviewed on local television in Boston and more or less took the cop's side. Basically said that his nephew was bad seed, or words to that effect. Absolutely no equivocation, came out and said his nephew was trouble.

I don’t know the last time a police officer in northern New Hampshire was shot in the line of duty, but it was probably around the time of the Harding administration. I can see why a NH cop wouldn’t want to wear one.

This is a VERY smelly story.I would bet that we get a lot more information on this as the victim’s(all of them) families start to speak out.

The article said that Kenney had been told he could request another officer, but it also said "Kenney told McKay to "get another officer," and then he sped off, according to Ayotte.."

As a lifelong NH resident I know of no arrangement in my state that allows a person to speed away from a traffic stop. My guess is that he was supposed to stay and wait till the other cop arrived. Driving away was his second mistake - after speeding, of course, and justified the police officer's decision to give chase and stop him once again.

McKay used a "small amount of force, not excessive" to move the car, Strelzin said. The officer got out of his cruiser, walked up to the driver side of Kenney's car and pepper-sprayed both Kenney and Macauley.

Nothing at all can justify the punks actions however the LEO didn't exactly make an attempt to diffuse the situation.

Why should he have to? Citizens are legally obliged to stop for a law officer. They are not allowed to speed away from one. Or should hothead 24 year olds be given extra special handling just because they have a personal gripe?

In retrospect, since the cop knew this kid and also knew where he lived, he could have let the kid speed on and sent another cop to stop him elsewhere down the road. But if he hit a tree or another driver in the interim, what would have happened to the officer?

Second guessing is easy enough after the tragedy, but it seems as if all the screw-ups were committed by the perp. He sped, he fled, he shot, he got shot.

It’s questionable how fast he sped away. Other accounts say he drove off slowly. The cop didn’rt seem to have any difficulty overtaking and pulling over a mile and a half up the road after calling for assistance. Things would have worked out better for many people if the cop had exercised a little restraint as I imagine he is trained to do.

Never said he was a model citizen. However, the officer should have defused the situation and called in a non-involved officer. It is basic law enforcement 101.

BTW, suppose this officer was in fact a bully that kept picking on you until you blow up? And you couldn't do anything about it because jeez... he is a cop.

The truth of the matter was this officer should have stepped away and called for assistance once he knew the situation. Which he didn't and cost him his life. The article said the officer escalated the situation by spraying pepper spray in the faces of the driver and his passenger after pulling them over the second time. Doesn't sound like a cool, professional police officer to me...
