Why? Why were Democratic Senators trying to pass a Resolution making Senator McCain undoubtedly Legally Eligible when this issue had already been cleared up in 2000 and again in 2004? And why did Senators McCaskill and Obama reportedly insert the following Clause?
“Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President;”

The problem with this is, if we force Obama off the ticket it may not matter since we vote for electors. Dems could vote for electors hoping that they would get a candidate who’s name we cannot mention.

That has been my concern as well.

I think your question exposes either an important flaw in the theory or a point of pressure on THE OTHER who would have to either be forced or enticed to take such a step. Or perhaps THE OTHER could not survive the race card; THE OTHER needed the black vote and for that to happen THE ONE could not be in the competition.
According to Judah Benjamin in her article at the head of this thread – allowing a person to seek the presidency when they are not, in fact, eligible would not directly fault THE OTHER. Here’s an excerpt regarding legal ‘liability’:
“In that event the Senate Ethics and Rules Committee, Chair Diane Feinstein, have a problem because they are responsible for the Certification of a Candidate’s Compliance with Constitutional Requirements, a job they would have conspicuously failed to do. Should he be Elected the poisoned Chalice would pass to Nancy Pelosi because as Speaker of the House she, and the House, have the Responsibility to ensure that the President Elect can Effectively be Sworn In and Legally Assume the Office and Duties of the President.”
This quote seems to imply still greater ‘stakes’ for increasing numbers of people. How could all of them willingly cooperate? Wouldn’t that mean they would have to be deceived?
If for some reason THE ONE ‘slipped past’ due diligence (convinced people that lack of proof doesn’t mean lack of evidence) then wouldn’t Nancy Pelosi WANT to check this out and/or hamstring it before it becomes her problem? Then again – Dems, truly in their hearts, do not believe that laws apply to them and may just plan on throwing themselves at the feet of the public in an appeal to modify the laws in the spirit of ‘fairness’ and ‘opportunity’ and the whole slithering idea behind the constitution being a ‘living’ document meant to be modified to embrace emerging human culture…after all….he was RAISED American…blah…blah….blah….
