Well, most places it would. But rumor has it that personal responsibility is against state law in Kalifornistan.
0.10 isn’t really drunk. Studies have shown that your reaction time at that BAC is not affected or is slightly better up to about 0.12. From that point on, it is safe to say there is impairment. But listen to MADD, 0.05 is drunk.
