A male prisoner can be strip-searched by a female guard even if male officers are available, a federal appeals court has ruled. In a 2-1 decision, the Ninth U.S. Circuit Court of Appeals in San Francisco dismissed an Arizona inmate's claims that jail officials had violated his rights by having a female guard trainee search inside his shorts and pat down his genitals. The inmate, Charles Byrd, was in Maricopa County's minimum-security Durango Jail awaiting trial in October 2004 when officials ordered searches of everyone in his unit after a series of fights. Byrd was ordered to strip down to his shorts.
A female cadet from a training academy pulled out his waistband, patted down his groin through the shorts and felt his buttocks to check for contraband, the court said.
The woman said the search had lasted no more than 20 seconds, while Byrd estimated one minute.
Byrd sued, claiming he had suffered pain and humiliation.

Women can strip-search men, but men cannot strip-search women... I thought we weren’t supposed to have gender discrimination/inequality anymore. [/semi-sarc]

You know...as a normal straight guy...If I had a choice between a normal straight male guard and a female bulldyke guard to search my crotch...I think I’d pick the bulldyke. If I could choose even further...I’d prefer the bulldyke’s woman over the bulldyke. But I’ll take a bulldyke over a straight male. If I had to choose between a straight female and a bulldyke’s woman...I’d go with the bulldyke’s woman.
Now imagine your own mother getting her crotch searched. Which of the above would you prefer your own mother get searched by?

Would it be more humiliating to be searched by a woman over a man? I'd have guessed there would be more problems with attitude from a male prisoner if a woman was searching them vs a male.

I'm surprised you bring it up. It seems obvious to me, but maybe we need a poll. To me this seems an additional punishment, beyond what male prisoners would experience with male guards. For female prisoners to have to endure strip searches by male guards would also be additional punishment.
I'd have guessed there would be more problems with attitude from a male prisoner if a woman was searching them vs a male.
That is another reason why this is such a bad idea. No one should be surprised when prisoners respond violently to being kicked while they are down.
I will be happy to retract my claim that this is sex discrimination the moment I hear that male guards have started routinely strip-searching female prisoners. That will never happen, even if it is perfectly legal.
