If it does turn out he’s not constitutionally eligible, they’re ALL open to international prosecution for war crimes.

Like Britain, we never have an interrex. Someone in the U.S. always has the power of the Presidency, right until the last Cabinet official is exhausted. And the Senate confirms candidates.

Only if they KNEW or had evidence to the fact.
That the congress has passed him in his “eligibility test” makes them exempt from this.
Now if they start making a fuss and show some questioning in that, then after they show some reluctance, then the argument can be made that they thought he was not truly in a position to give orders, but they followed them anyway.
It’s a catch 22
