Yeah, but if the ticket were a fraud to begin with, Biden would be out of a job. I can’t imagine that a fraudulent ticket would allow the 2nd layer of fraud to serve in his absence.
We either have an Electoral College, or we don’t. Since the Kenyan got the most electoral votes (and not Biden), I should think that those votes would be thrown out and McCain/Biden would step in. I can’t see succession withint a fraudulent ticket.
But the entire ticket would be fraudulent. This would not be an issue at all if the offices-holders were voted on individually, or that the second-place president would be the vice-president.
It would not be President Biden but President Cheney who would hold office until a new (non-fraudulent) election could be held.
After reading everything I could find on replacing a President that is what I find. The only way I could see that NOT be the case is if someone then sued to have the Obama Ticket deemed not eligible due to having someone who did not meet the requirements and deceived the voters. (There have been cases filed and affirmed based on equal protection of the voters IIRC.)
