That incident will be on their “record” forever and will be used against them, probably again and again. If the child falls and gets a scrape which is then reported by a teacher to the local version of Child Protective Services, it will be added to the Drug Charge and the kid will probably be taken all over again.
My wife is a primary school teacher and she is required by law and rules to report any hint of a bruise or scrape or any possible “injury” to CPS. She thinks that is a good reason for people to homeschool their children though she may not recommend that to any parents.

There was a day when a lot of women showed up in the Emergency Dept. in full labor without a doctor and no prenatal care. Some of these women had syphilis and other STDs which could be passed on to the baby, so laws get passed and now everyone gets tested even if your risk is 0%. The crack “epidemic” led to some real horror stories in the delivery room. But how much of a problem was/is this? Most women have routine prenatal care and are not drug abusers or alcoholics. Why subject everyone even when there is no probable cause for concern? These screening/prophylactic policies should be changed to apply only to those who have not received prenatal care and “just show up” at the hospital ready to pop.

The government does not own people. Not seeking prenatal care is a crime? I would rather strip government of it's authority and power and accept some collateral damage. That kind of collateral damage is way more acceptable than the collateral damage caused by “do good crusaders”. Judgmental caregivers. It is a huge mistake to in any way link health care providers with criminal authority. I am not alone in being reluctant access health care for this reason. I had a ceiling fan blade brake off hit me in the head. Required stitches. At E.R. They asked me “do you feel safe at home”? The more times I told the story the more concerned looks I got from staff. I wanted stitches. Instead I got social intervention of the worst kind. All of it was leagal. All by the book. I say “F” this do gooder Statist world. Defund the government. Turn off the lights at city hall. Get rid of the corrupt cabal of otherwise unemployed lawyers infesting city hall, State legislators, prosecutors offices, judges. All corrupt. All smell of the foul ooze of gangrene, welfare for the overly educated and law and order Statist control.

I sure if there’s a law mandating reporting, that it has a threshold, or says “above the legal limit” or something to screen out false positives and test variation. She only wiggled the needle a small fraction of what would have been required to cost her employees at the government their JOB, and it cost her her CHILD.

Next, we have federalized health care.
Digitized medical records in a government database.

ARE YOU KIDDING ME?

How is any of this a good idea? We are headed for 1984. That's not hyperbole.

There is a standard for people to live by, called the Bible. You call me a bigot because because I said that this couple chose not to live by that standard. Oh, that really hurts. Not. If more our of society refused to accept this conduct maybe people would be shamed into changing their ways. You seem to condone this practice, I don’t period. There is a reason why blacks have 7 out of 10 children out of wedlock. Boy, that is working out real well for them. This corrupt practice is creeping very quickly into the rest of our society bring detrimental results. “Partner”.

Oh no, I’m not defending any reporting requirement. The point I was making was to not let the drones at the hospital off the hook for putting their brains in neutral and their bodies in drive.

I have some skepticism about this story. Having seen a lot of drug prosecutions based on urinalysis, I have to say the “poppy seed bagel/cake/cupcake/pastry” is one of the oldest “defenses” in the book.

It never worked. There was so much contrary evidence that, even if poppy seeds could, in some instances, maybe show up on a drug test, it was almost impossible for them to cause a false positive considering the level of metabolite that had to be present and the formulas for calculating half-life, etc.

Long way around of saying, yeah, I have some skepticism about this story. I’d need to know more about the type of test conducted, the actual blood level, when the test was taken compared to when she said she ate the bagel, etc.

If a screening test was the basis for the action, then there’s a problem if there wasn’t other evidence of exigent circumstances.

I agree. I had a sheriff's deputy called to the ER when I went in for a kitchen accident because it was a "Knife Wound". Federal Law. He asked me "What happened?", and I told him "The roast beef won."

That said, NO ONE in this area (heavily employed in the oil industry) who is subject to random drug tests, eats anything with poppy seeds on it any more. It isn't worth your job/reputation, and stories of someone having lost their job over a 'dirty' test for opiates (which are not common on the local drug scene) are common.

That is not how Federalism is supposed to work. What did they use? Commerce clause? Because the steel crossed State borders? More than likely RICO, an unconstitutional act.

That is not true. My daughter is a nurse and has seen many instances where eating a muffin or bagel with poppy seeds does indeed produce a positive in tests. I owned a trucking company and we knew not to eat them because if a random drug test is performed, which it often is, we could test positive.

I couldn’t agree with you more - health care providers are supposed to ask you this question in every health assessment they do by law (do you feel safe at home). The Nanny State is going like a maniac to take over our lives. We must resist, but we do it at our own peril because you can end up losing your job, your livelihood, your health insurance, everything, when you buck the Power Elites.

I have to take a FIT test every year....

It's a test to make sure I know how to wear a mask over my nose and mouth.

I'm a health care professional....

The paper work is a joke....The very first question is: Can you read? Yes or No.

I kid you not.......

Then they ask all sorts of personal questions....I just put N/A on most of them.

They can pound sand.

I believe a lot of hospitals run a test on the babies after the women get out of the delivery room.

Ridiculous! Do they force you to have the flu vaccine where you work? I am about ready to let them fire me if they refuse my declination. Imagine - excellent employee with blemish-free record refuses flu shot and is fired (I don’t take care of patients, but that isn’t the issue - there are other ways to protect patients).

No..they don't force us. And I've never taken one.

But this year we had to fill out paperwork...officially saying we declined the flu shot...and why.
