CHICAGO, April 15 (UPI) -- Sears Roebuck and Co. filed a lawsuit in Chicago against the makers of a "sexual enhancement spray" for using its Diehard trademark.
The U.S. District Court lawsuit, which Sears filed along with subsidiary KCD, accuses Rockhard Laboratories LLC of trademark infringement and deceptive trade practices, the Chicago Sun-Times reported Friday.
KCD is the owner of the Diehard brand, which includes car batteries, auto parks, hats and boots sold at Sears.
The suit states Rockhard Laboratories has been using the brand name "Die Hard" for a "numbing agent for male genitalia" since 2010.

If users don't drop dead and go into rigor mortis (throughout the rest of their body) after using the product, can they sue for false advertising?

The Sears catalogs of the early 1900s pictured a ring-like device on a belt which was supposed to electrically stimulate male performance.
Seems like some concerns never change.

My SUV needs a new battery. Are Die Hards worth the extra $$ ?No. Die hards are made by Johnson controls. You can get the same batteries made by them (same CCA) for less at Costco and Wal Mart. (It's been a few years since I looked at batteries at Wal Mart but they were Johnson control products last time I looked.)

Johnson control products I am fairly certain that the topic of this thread is about Johnson control products.

This should be a class-action suit with the tequilla bottlers.
