Microsoft worker denied paid leave for brain surgery

This man is a 10-year Navy veteran and 11-year microsoft employee. According to the news story an undiagnosed brain tumor affected his job performance and his manager "threw him under the bus" (gave him an unsatisfactory performance rating. According to the news story, once the brain tumor was diagnosed, Microsoft revoked his disability insurance because of his unsatisfactory performance rating.

With rare exception, just about every company in private industry does this sort of crap. It’s called risk management.

Well we can’t have the big evil government step in and tell an honorable company what to do. Obviously this gentleman can try to go to Canada to get his hand outs like the leech he clearly is because in this country the free market handles everything just fine!

MS has lots of money to lose and to defend against losing. I would think covering his insurance would be cheaper.

WTF? I've never heard of anything like that in my life. First off, it sounds illegal.
Second, just how many people have you known on disability?
It doesn't make any sense for MS to use that as a "carrot and stick" incentive unless they have a heck of a lot of employees using (abusing?) disability leave.

When health insurance is tied to your job, you can expect your employer to throw you under the bus.
When health insurance is tied to the government, you can expect the government to throw you under the bus.

If health insurance is something you purchase on the open market, then you will be better off. Throwing their customer under the bus would just be bad for business, so the private insurance companies are less likely to do this.

Well, guess what, smartass, there already are laws and regulations against such a thing, yet, it still happened. How many more laws do you think we ought to add and then ignore??

If government would get out of people’s lives and medical care then we could get back to the people buying their own private insurance and no corporation would even be in the decision chain.

GOVERNMENT IS THE PROBLEM!!!

Yet private insurance companies do it just the same....That was Obozo’s big selling point, if you recall...

Still it does happen to people.

But in this case MSFT, the big lefty lovers...they should be payin this guy a bonus plus his bennies.
Thats what they push for when they support the likes of [insert favorite dumble name here....]

Something doesn’t seem right here.....NEVER heard of disability insurance being linked to performance...(yes, I was in HR at one time...in hi tech).

Sounds strange to me too.
MS is far from the best Hi-tech compay out there but I’ve never heard of them doing anything like this.

This is the sort of question that should be resolved by jury trial.

One key issue is whether Microsoft has discriminated unlawfully against a person because of a medical disability. I am not sure it would matter that the disability be documented or diagnosed at the time it first occurred.

Another issue is whether Microsoft fraudulently claims to offer disability benefits, in cases where it revokes the benefits when they are used.
