Vanity- Oklahoma gun law question

Posted on 07/11/2011 11:57:26 AM PDT by TexasBarak

Just a quick question for Oklahoma Freepers- I live in Texas, and am planning a quick trip to OK tomorrow. I'd like to know if, or under what conditions, it is legal there for me to carry a pistol in my car. I know that it is legal in Texas, but I'd like to know if I'm headed for hot water over the border. Thanks in advance for any info- I won't be able to reply for a couple of hours- gotta take the wife to the doctor!

I know they recognize my MASS LTC, so I cannot imagine it would be a problem for an Ok. However do a search for reciprocal agreements.

If you do not have a conceal carry permit in a state with a reciprocal agreement with Oklahoma - you will be a committing a felony in Oklahoma by having a loaded firearm (handgun or long gun) in your vehicle. It used to be a misdemeanor but changed when they passed CCW. If you get stopped in Oklahoma County (OKC), you will be charged, no questions asked. While OK has CCW, according to our local District Attorney, you have no right to self defense outside your home.....red

Bring it on. We have reciprocity.

It’s only open season on liberals.

Per Oklahoma Title 21 § 1290.26, the State of Oklahoma “recognizes any valid concealed carry weapons permit or license issued by another state. The license must be issued by the state and must be carried fully concealed from detection and view...”

if you don’t have a ccw, you must carry the weapon unloaded. i don’t know if it has to be in “plain view” in the vehicle. you would probably be advised to inform the officer if you’re pulled over that you have an unloaded firearm in the glove box, or wherever it’s at.

Without a permit, it has be unloaded and better be locked in the trunk. If it is out in the open, you will go to jail....red

Automobile carry:
Unloaded firearms may be carried in the passenger compartment; magazine loaded rifles and shotguns may be transported in an exterior compartment or trunk.

Places off-limits when carrying:
1. government building;
2. meeting of any elected or appointed government officials;
3. prison or detention center; elementary, secondary, or
4. vocational-technical school property; sports arena during
5. a professional sporting event; any place where pari-mutuel
6. wagering is authorized; college or university property and
7. any other place specifically prohibited by law.

Except for any elementary, secondary, or vocational-technical school property, these prohibitions do not apply to parking lots.

Deadly Force / Castle Doctrine:
Oklahoma is a Castle Doctrine state and does have a stand-your-ground law.

I would also consider getting one of these:

I have used them to point out to LEO’s what the laws actually are.

When I get pulled over, I usually yell out the car window "I have a gun!" ;)
Your results may vary...

When I get pulled over, I roll down the window (if at night I turn on the interior light), put both hands on the window sill palms up and when the officer/trooper approaches I immediately advise him/her that I have a loaded handgun.

I have been told several times that the above behavior is highly advised, and has saved me from a ticket on more than a few occasions.

Hmm. I am with you until the last statement. I have been told that I should say "I have a CCW permit and I am legally carrying" or something like that. My instructor told me it has a lot less "oh s%^t" factor for the LEO.

BTW, More than a few occasions? What the heck? You have to seriously review your reasons why you are getting stopped so much by the LEO's :)

I am a hospice nurse. I routinely drive at high speed to dying patients.... but only on uncrowded roads in good weather.

If I had received all the tickets I truly deserved, I probably wouldn’t have a license. Gotta go to court on 8/11 for a 76 in a 45.... BS speed limit on a 4 lane divided highway. Trooper cut me NO slack at all.....

GA State Patrol would ticket their own Grandmothers... :(

Oklahoma’s Constitution says:

Section II-26: Bearing arms - Carrying weapons.

The right of a citizen to keep and bear arms in defense of his
home, person, or property, or in aid of the civil power, when
thereunto legally summoned, shall never be prohibited; but
nothing herein contained shall prevent the Legislature from
regulating the carrying of weapons.

Yes, your Texas license to carry a concealed handgun is honored by ccw reciprocity in Oklahoma. The Texas license is good in most (but not all states.) This site shows what other states will honor your CCW permit. They also have links on how to get a CCW permit if you don't have one. An important point to note for anyone wishing to visit OK is that The permit must be issued by the state and not a county or law enforcement agency.
