US judges rule for teacher who called creationism ‘superstitious nonsense’

A public high school teacher in California may not be sued for making hostile remarks about religion in his classroom, a federal appeals court ruled on Friday.

The decision stems from a lawsuit filed by a student charging that the teacher's hostile remarks about creationism and religious faith violated a First Amendment mandate that the government remain neutral in matters of religion.

A three-judge panel of the Ninth US Circuit Court of Appeals ruled unanimously that the lawsuit against an advanced placement history teacher at Capistrano Valley High School in Mission Viejo must be thrown out of court because the teacher was entitled to immunity.

The San Francisco-based appeals court said the teacher was entitled to immunity because it was not clearly established in the law that a teacher's expression of hostility to certain religious beliefs in a public school classroom would violate the First Amendment's establishment clause.

Check out the politics in Singapore. During the time of the communist scare and our McCarthyism Singapore took it a few steps more then McCarthy could have and imprisoned the whole left wing party of Singapore at that time. To this day the left wing party is still not allowed to enter politics to any significance.

Years ago I learned NAZI's were left wing and then thought to myself what is the most extreme right wing event in history? Singapore politics was and is.

some religions accept evolution. some don’t.
(in fact, many Christians accept evolution,
whether you agree with them or not,
because they don’t take Genesis literally.
just as the 7 “days” of Daniel aren’t taken literally.
...just as they believe God didn’t stop the Sun for Joshua,
as it literally says,
but instead stopped the rotation of the Earth.)

i don’t believe that man causes Global Warming.
(in fact, i believe the Earth is cooling)
yet Public schools teach “AGW”.

i see no solution, other than giving ALL parents a voucher,
and allowing them to select a school, that teaches what the parent is comfortable with.

You know, just like the Romans used to do in the Republican times when things were getting out of hand, someone who was given absolute power for a limited time, with a life-time immunity for the decissions made while in office.

The policy worked reasonably well for several centuries, up to the time of Sulla and Caesar, when it became mostly a way to legally massacre your opponents and steal all their stuff.

You may note that in most of my comments I referred to what I believed PUBLIC SCHOOL teachers should do - take an agnostic approach.

Of course private schools should always be allowed to set their own curriculum.

The core of agnosticism comes down to “neutrality” because an agnostic believes that the question of the existence of God cannot be answered, therefor while the agnostic will not claim to know that God exists he does not deny the possibility.

Thus the true agnostic will (a) not be an advocate for a religious view, (2) will not deny that others may believe it.

My proposition was not what the “real world” does (in education) but what the real world of PUBLIC EDUCATION ought to do.

My argument was not to lay out all the ways the standard I proposed is breached today, but to propose a standard that SHOULD BE followed.
