BREAKING: Rick Perry Files Lawsuit To Get On Virginia Primary Ballot

Texas Gov. Rick Perry has filed suit in federal court against the Virginia Republican Party and the Virginia Board of Elections in order to gain a spot on the Commonwealth's primary ballot. Perry was excluded after the party found he had not submitted enough valid signatures by the deadline last Thursday. His campaign submitted 6,000 of the required 10,000, according to the suit. The lawsuit alleges that Perry's 1st and 14th Amendment rights were violated by the requirement that those circulating the petitions also be eligible or registered voters of Virginia. Failure to get on the ballot is a major embarrassment for the struggling Perry campaign — but he is not alone. Another one-time GOP frontrunner, Newt Gingrich, also failed to qualify. "Gov. Perry greatly respects the citizens and history of the Commonwealth of Virginia and believes Virginia Republicans should have greater access to vote for one of the several candidates for President of the United States," Perry communications director Ray Sullivan said in a statement. "Virginia ballot access rules are among the most onerous and are particularly problematic in a multi-candidate election. We believe that the Virginia provisions unconstitutionally restrict the rights of candidates and voters by severely restricting access to the ballot, and we hope to have those provisions overturned or modified to provide greater ballot access to Virginia voters and the candidates seeking to earn their support."

He was in Creston, IA. It was a packed house and Perry was ON!!

I talked to a reporter who had been in Council Bluffs in the am for an event for BAchmann, which only attracted a handful of supporters.

This was the second event of the day for the reporter with Perry. Both events were packed and I just saw a report on FOX with Perry in Osceola, IA. It, too, looked packed.

Great news....how did the crowds react to Perry?

Sheesh. He didn’t even get the minimum requirement. This is totally unsat. He has been in the race for months and could not get 10 thousand signatures in that amount of time. He does not deserve to be on the ballot.

Virginia does not have party registration. It used to be a Democrat one-party autocracy. They didn’t imagine it’d ever be necessary to register Republicans.

That's screwy to me. I just moved here from California where I hate the politics but VA politics are starting to look pretty screwy too.

When a self-declared conservative starts filing lawsuits like a liberal because the rules "aren't fair" you can hear the Fat Lady clearing her voice in the distance.

You're failing to make at least a couple important distinctions:
1. the liberal files suit against someone whose actions don't directly affect him on behalf of someone else whom the liberal claims he is trying to protect. That's not happening here.

2. filing suit against someone whose actions you believe have harmed you in order to seek relief is the basis of tort law; that's been going on for hundreds of years and has nothing to do with liberal or conservative. Trying to pass laws to anticipate and criminalize every conceivable transgression of an ideologically-motivated agenda is the liberal way. That's also not happening here.

From what I understand is that they were just going to ensure the signatures were correct. That is it. Perry didn’t even get the necessary minimum signatures. One thing for sure, if Perry and Newt get on the ballot then I think they All should get on the ballot and that includes Santorum, Bachmann and Huntsman. Perry will not be on at least two states....why is he not fighting for Michigan? Do all the other states require signatures to get on the ballot?

It is most appalling that media, and “elite” members of the Republican party have not been honest with the American public. I am not surprised at the media, though FOX news has sunk so far down, they are slightly better than MSNBC in my mind. ALso on my list to “not listen to” are Hugh Hewitt, Ann Coulter, Peggy Noonan (she went down some time ago) and Krautheimer...I’ve never liked Chris Wallace and he’s turned out to be just like his dad.

I still think that RUSH needs to throw his 20 million listeners into the voting pot by opening up a huge “money bomb for NEWT” one day and another money bomb for Perry the next since they have been totally screwed by the RNC.

The one positive thing in all this is that it will toughen up the candidate who will eventually face the Obummer and his Thugs from Chicago...it’s going to be ugly and I’ll tell you this much, we’re going to need someone who can really fight out loud (FOL). I believe it is not too late for Rick Perry and Newt still holds the overall lead NO MATTER HOW MUCH THE MEDIA TRIES TO PUSH THEIR WISHES ON TO US!

I’ve just been told that VA has “open” primaries where any and all lunatic-fringe leftists can vote in a Republican primary possibly helping to defeat a candidate most Republicans vote for? Will somebody tell my why open primaries aren’t one of the worst ideas in politics?

Both Perrry and Gingrich got enough raw signatures to qualify...the other three candidates didn’t even file for VA. Paul and Romney had both already run there before and qualified on raw signatures, but this was the first time primary candidates were scrutinized. It was done by computer and a signature could be disqualified if somebody had written Elm St instead of Elm Street (or however it was registered ).

This was a fluke as the result of a recent lawsuit, but Perry and Gingrich should sue because the others were qualified by a different standard.

A candidate who can transform the system must be able to oppose his own party, take stands that are unpopular with the status quo and fight to preserve the Founder’s vision. That takes BALLS.

Filing against your own party then going there to compete takes BALLS.
