Since this thread concerns Planned Parenthood, please consider the following. Given that there is nothing in Section 8 of Article I of the Constitution which would justify Congress funding PP, Justice John Marshall had officially clarified in general that Congress is prohibited from laying taxes for such things. In fact, here's two excerpts from Gibbons v. Ogden which Justice Roberts used to help justify his stance on Obamacare, but which indicate that activist Roberts either ignored or overlooked key statements in Gibbons.
"State inspection laws, health laws, and laws for regulating the internal commerce of a State, and those which respect turnpike roads, ferries, &c. are not within the power granted to Congress (emphases added)." --Gibbons v. Ogden, 1824.
"Congress is not empowered to tax for those purposes which are within the exclusive province of the States." --Justice John Marshall, Gibbons v. Ogden, 1824.
