SCOTUS should overturn DOMA, Obama administration says

In a brief filed Friday, the Obama administration is arguing that the 1996 law barring recognition of same-sex couples by the federal government for income tax purposes, federal employee benefits and other programs violates equal protection guarantees under the constitution.

The Obama administration has pushed courts to overturn the Defense of Marriage Act for two years.

I know you mean that sarcastically, but there is more and more evidence that 0bama has very damning blackmail material on Roberts that keeps him under his control.

Liberals are allowed to pick and choose the laws they want to follow. Liberals are allowed to say and do anything if done in support of a liberal cause.

I’m always puzzled about homosexual marriage, in that, it wasn’t always a liberal cause. If you go back and check the vote for the Defense of Marriage Act in Congress, you will see many reliable liberals, such as Chuck Schumer, Joe Lieberman, Pat Leahy, Tom Harkin, and others, who voted for the Defense of Marriage Act.

What changed between 1996 and now? Why has homosexual marriage become a liberal cause celebre? Why do we see so much homosexual propaganda on TV nowadays? Why did liberals adopt homosexuality as their cause? It wasn’t always that way. At one time, in 1996 for example, liberals were willing to say that marriage was a man and a woman.

Today, such a viewpoint is verboten. Even many conservative politicos won’t even talk about homosexual marriage anymore, to express opposition. It’s like this issue is just rolling over us by default.

scotus would say, we don’t make the laws, repeal it yourself.

if scotus still had testicles.

course the whole drug dog search verdict they came out with really eroded rights, given sniffer dogs false a lot, and some a lot more than others depending on training. no different than a crappy cop who think probable cause is ‘because i say so’.

Erosion of rights is a pernicious thing. Like the flow of a river undermining its banks, nobody realizes the extent until the bank crumbles and slides under water.

That repository of case law and now Shari’a known as the “Supreme Court” has become about as impartial as the French courts under Louis 14th. The Code Napoleon, draconian as it was, was a vast reformation over the earlier application of what passed for law in France.

Our own application of law has become a bad parody of that hodgepodge which had existed in the days before the French Revolution. Now it has become different applications of the law for different classes of people, or the failure to even try to reconcile completely contradictory statutes, to the point where some laws are arbitarily applied, or ignored, on the whim of the prosecutor. Or worse, in response to some elected or appointed civil authority.

This only strengthens and reinforces my personal preference for division of the geographical area once known as “the United States of America” into two distinct regions identified by either “red” or “blue” on electoral maps of the most recent Presidential and Congressional elections.

What would be the “red” region is much larger and nearly contiguous, while the “blue” region is much fragmented and concentrated in islands amid the “red” area. And it crosses state lines, so the division would be based on Congressional districts and counties, not existing states.

The “red” region would continue to be governed by the classic interpretations of the Declaration of Independence and the essential parts of the US Constition, while the various small “blue” republics could go ahead and write whatever set of cockamamie rules they wanted for THEIR governance.

Balkanization is not something anybody looks to as an ideal, but it may be the only feasible resolution for the decay of legal foundations that once governed this nation.

Balkanization won’t help.

given the red/blue borders you mention, they aren’t obvious or visible, people’s expectations of justice will be unpredictable. they won’t know what to expect as there’s no red/blue demarcation, and these borders change arbitrarily across periods of time.
