Give her the death penalty, then she can ask for mercy and give her life in prison “without parole”.

Not sure if they can give her ‘life without parole’. Which she then may be able to get off early.

Key is he did ASK and she complied. I know married people who have no problem incorporating various “styles” of dress into their intimate moments. Whatever floats their boat.

So it really isn’t an issue though she tried to make it so.

No way, Josette! Although I'm running all-seasons at the moment, but when the snow comes, it has to be dedicated tires. Studded? Not good enough. I'm running steel-spiked ka-nobbly tahrs made of recycled endangered-species black rhinoceros hide. When small, furry mammals - deer, for example - dare to cross the road in front of me I stomp on it and watch the sanguinary fountain spray to the very heavens as the death screams of the victims echo off the...uh, wait, what was the question again?

By the way, since you are saying that only people of exceptional character should have their murders punished with the death penalty, I think it's fair to ask:

If someone murdered you, are you a "good enough," person for that murder to be punished with the death penalty?

This is why, and perhaps not all people here may agree with me, I am against “victim impact statements” at sentencing hearings.

Here is why and my example for consideration.

Suppose that two different women (victim 1 and victim 2) were abducted from an office building parking garage after working late one night. They were both brutally raped and murdered at random by a stranger (just in the wrong place at the wrong tine - a crime of opportunity), their bodies dumped in a river under nearly identical circumstances but by two different and unrelated perps – two different crimes, two different perps but otherwise the crimes were identical in brutality and in execution except for the victims.

Suppose that victim 1 was an exceptionally pretty, petite, outgoing and very popular married 42 year old mother of 3 bright and beautiful children, a bookkeeper for a mid-sized company. She had 5 siblings and 10 cousins all of whom she was very close to and many aunts and uncles, both her parents are still living as are all four of her grandparents and a great grandmother and of course a husband who loved her and misses her very much. She was an active member of her church and of many civic organizations; a volunteer at her kid’s school, a den mother, a member of the PTA, her neighborhood watch, the garden club, raised money for charitable causes and volunteered at a homeless shelter and she was much loved and respected by all her co-workers and all her friends including those in her weekly Bible Study group and her Book of the Month reading club and her Pilates class and her running club - she recently finished her first marathon in which she ran with and for wounded soldiers to raise money for the WWP. Her murder and the trial of her murderer was big news locally, it was covered extensively by all the local TV stations and newspapers, even nationally. A Face Book page was created in her memory and many hundreds attended her funeral. At the sentencing hearing of her convicted murderer there were many dozens of people who gave tearful “victim impact statements” - many who told the judge and many dozen more who were willing to tell the judge why the world is a lesser and colder place without her and why her murderer should get the maximum sentence, the death penalty.

Then we have victim 2. She is also 42 and a bookkeeper for a mid-sized company. But victim 2 was never married, never even dated or kissed a man, and never had any children. She was in fact very shy, a bit on the homely side, frumpy and overweight in fact. She was the only child of an only child, victim two's father died when she was little and her mother is in a nursing home with advanced dementia, otherwise she has no living or close family members saving for a 2nd cousin who lives on the other side of the country and met her only once when they were children and who stopped sending her Christmas cards years ago when she never got one back. Victim 2 stayed to herself. She never went to church, didn’t belong to any organizations outside of work, she had no close friends. She went to work every day and did a good job but had no friends at work; in fact she never interacted with anyone except when her job demanded her to do so as she was so painfully shy and socially awkward. While she didn’t make enemies at work or in her apartment building, neither did she make much of an “impact”. Most of her neighbors didn’t even know her name and barely registered her comings and goings and neither did many of those working for their same company, most of them only knew her as “that mousy and painfully shy woman in the accounting department” – the “fat frump” they called her. In fact after she was murdered it took over a week for anyone to report that she was missing and that was only then by her supervisor who noticed she hadn’t closed the books for the month and finally noticed she hadn’t answered any emails and hadn’t filled out a time card for the last week. Her life was basically, “get up, go to work, come home, read a book or watch a little TV, go to bed, rinse and repeat”. Her murder was only a small 3 line story buried on the 3nd page of only one local newspaper and no reporters covered the trial. She didn’t have a funeral but was cremated and it was only after the funeral home repeatedly contacted her as victim two’s only known living relative, did her 2nd cousin begrudgingly agree to take and dispose of her ashes. At the sentencing hearing of her convicted murderer, there was no one willing to make any “victim impact statement” live alone a tearful one – no one willing to tell the judge why the world is a lesser and colder place without her and why her murderer should get the maximum sentence or even why he should not get a light sentence with a chance of parole after 10 years.

So my question is, if “justice is blind” and truly “just” and objective, and it is the criminal on trial and the crime committed and not the merits or lack of merits of the victim and or her character or her popularity and if the perp is convicted based on the evidence of the actual crime, then why should the murderer of victim 1 get a harsher sentence or conversely, why should the murderer of victim 2 get a lighter sentence? Why should “victim impact statements” have anything to do with sentencing one way or the other? Why should the popularity or likability of one victim over another even weigh into the equation if all else is equal?

Let us also suppose that there was a victim 3 who was also a 42 year old woman, a bookkeeper working late one night who was also abducted, raped and murdered under nearly identical circumstances. But victim 3 was a very nasty and highly unlikeable person, perhaps even someone with kinky tendencies and a like for strong drink, even a drunk; divorced several times, she had children but children who now as adults want nothing to do with her nor did any of her relatives, she had no friends but did have many “boyfriends” and even a “girlfriend” or two over the years; someone who not only chased kids off her lawn and kept their errant balls but also called the police on them and harassed their parents over it and was a serious PITA to her HOA but then someone who also had multiple complaints against her by her neighbors for not keeping her lawn cut or her home in good repair, someone who had filed several lawsuit against various past employers over the years for frivolous reasons and filed a few suspicious workers comp, unemployment and auto insurance claims. Should her murderer get an even lighter sentence because we find her, unlike victim 1- very popular and likable or victim 2 -rather forgettable, but truly unlikable?

A correction! Hop Stoopid is Lagunitas Brewery. Which doesn’t change my opinion on the designated hitter rule. Deschutes, though - that’s Hop Henge. Still capped. Can’t find the opener, gotta go get the .45. I hate it when that happens.

Well I think she’s saying she wants the death penalty because she’s hoping the jury will then give her life...she doesn’t want to die.

She gave herself away by adding...”My family has longivity so I would probabaly live a long life...yada yada yada...”

The verdict in the Arizona vs Arias case was simply obvious from the beginning. Stabbed in the heart (fatal wound), shot in the head (fatal wound), and 28 other various stab wounds (non-fatal), and a slit throat to almost the point of decapitation (fatal wound).

And her plea is SELF DEFENSE????

She is guilty of first degree premeditated murder with aggravating circumstances. There is no doubt, and you couldn't be more wrong. She will easily get the death penalty.
