Rush just said that Lerner will be called back; that she waived her right to invoke the 5th!! Gowdy was right!

When I heard her claim she did nothing wrong, she was invoking the Nazi defense, I was just following orders. She has implicitly implied that someone above her gave her orders.

Who made the determination that she waived her right to claim 5th amendment protection? Lawyers always advise clients to invoke the 5th - even if asked their name. Otherwise, courts may rule that the privilege has been waived.
