‘YOU COULD NEVER ANTICIPATE THIS HAPPENING IN THE UNITED STATES OF AMERICA’
The Blaze ^ | 5 Nov 2013 | Jason Howerton

What began as a simple traffic stop ended in a humiliating and nightmarish ordeal for a New Mexico man. It won’t come as a surprise to most people why the man has now filed a federal civil rights lawsuit.

The incident began on Jan. 2 as David Eckert was leaving the local Walmart in Deming, N.M. He reportedly failed to make a complete stop at a stop sign, prompting police to pull him over.

The officers asked him to step out of the vehicle and claim the man appeared to be clenching his buttocks, Eckert’s attorney, Shannon Kennedy, told TheBlaze. It is unclear why police removed him from the vehicle in the first place. However, because the cops believed he was clenching his buttocks, they took it as reason to suspect him of hiding narcotics in his anal cavity. Police officers detained Eckert while they sought a search warrant for an anal cavity search.

“What is so strange about this case is they held him with no evidence,” Kennedy said. “They seized him to collect evidence, to go on a fishing expedition on someone’s body.”

Upon securing the warrant, Deming police officers took the man to an emergency room, but hit their first snag when a doctor refused to perform the anal cavity search because he believed it to be “unethical.”

So police tried again at the Gila Regional Medical Center in Silver City, N.M., where doctors agreed to the search.

KOB-TV outlined the disturbing series of events that occurred next, details confirmed by medical records and official documents provided to TheBlaze by Eckert’s attorney:

1. Eckert’s abdominal area was X-rayed; no narcotics were found.

2. Doctors then performed an exam of Eckert’s anus with their fingers; no narcotics were found.

After reading this, I'm actually surprised they didn't kill him and perform an autopsy.......where no narcotics were found.

Wouldn’t the DA have to file charges?

The DA was involved in the rape and humiliation of this man.
He or she is going to cover ass too.

I’d be fine just tearing apart every aspect of their lives, and know that they would never get a job again. These people cannot be in these positions, they are incompetent, vile, jackbooted communist thugs. All the rest of their comrades in the state need to see what happens to them if they cross the line.

Eckert’s past history does NOT justify torturing the man. For the love of God, we treat TERRORISTS better than this!!!!

<< In honor of this incident and Pancho Villa’s 1916 incursion, I suggest the town rename its sports teams the “Deming *ss Bandits.” >>

LOL. I think I’ll take a drive to New Mexico. If I time the dosage of Miralax just right, I can get myself pulled over for a minor traffic violation at just the right crucial moment.

“M’am, you can get back in your car. Wait, why are you standing funny like that?”

“Uummm.... No reason. But I really need to go. Lets get this ticket over with so I can go.”

“What do you mean you have to go?”

“I just have to GO, okay? Now write the ticket and let me go already!”

“M’am, why are you scrunching your butt cheeks together like that? Are you hiding something?”

“No, and I have to go! Now!!”

“Lady, you’re not going ANYWHERE except to get an exam!”

(Exasperated demeanor) “But I TOLD you I don’t do drugs! Now let me go THIS instance! I have to GO!”

Of course, proper timing of the inevitable, massive and explosive bowel movement would be important for full effect, preferably during the squad car trip to the hospital for my anal rape.

After sufficient pain, suffering, and mental and emotional anguish was reached, my lawyer would receive a call. ;-)

He should get a billion. “The taxpayers” (AKA the most influential constituents) chose the government, control it, and are responsible for its actions. Stop voting for gangsters.

"Good grief! The hospital billed him for the rectal exams, enemas and colonoscopy."

That's one of the reasons that it's called the medical racket.

Sued, hell.

Impaled on a stake and left in the desert to die is more like it.

That’s a good start. Additionally, what one can do:

7) Find all names, addresses and other information on the guys who did this. Hire assistants who have no qualms about inflicting pain. Invade the perp’s home, drop his pants and tie him in a bent over position. Have his family watch as he is anally probed with a succession of artifacts, ending with a rolled up copy of the Constitution. Inform the family they will be freed when all other perps are similarly dealt justice. Send copies of the video on the perp’s email account to his friends.

Not that I would do this, just saying others probably would.

The lesson they will learn is next time have an unfortunate accident happen in the hospital that results in death.

Haven’t you heard about police training dogs to do false alerts? (they never found any drugs)Just because one crooked cop tells another that Eckert had hidden drugs up his bum, you take that as sacred truth? According to the lawsuit it was not true, so don’t believe what that crooked cop says.

You believe in innocent until proven guilty?

It is amazing that they didn’t “find” their own stuff. After that kind of procedure they really needed to find something to avoid the lawsuits and stuff. Police routinely plant evidence anyway, why did they not do that with this person? Or was this someone who had beat a couple of traffic tickets from the same cop? When you make a local cop look foolish or make him feel “dissed” then you really should move very soon to a jurisdiction far away.

I hope he gets $10 million from these idiots and serve as a warning to other idiots.

No warning will be taken, no matter how egregious the offense, unless the officer actually does prison time. Money damages don't affect anything except the taxpayers who must pay those damages.

I don’t think a dog alerting is grounds for a warrant. Too darn easy for the handler to signal the dog, consciously or unconsciously.

Sniffer dogs have their place but the average stop or questioning of a citizen is not one of them.

Also IMOthe whole war on drugs is far more harmful than the drug problem. Let’s legalize marijuana and opium derivatives - if they’re easy to get hold of, maybe there will be a lot of mellowed users, and fewer people raging around on meth or PCP.

Deming is an incorporated town. The money will be paid by an insurance company and recouped over time by increased insurance rates for Deming which will be paid for by increased taxes or “fees” like sewer and water. It is no skin off the noses of the officers and officials involved. If the people involved had to do some prison time then it might make other officials think twice. Won’t happen. I do hope the doctors who did this are big targets in the lawsuit.
