Unintended consequence of Colorado's new marijuana laws: you can't buy a gun.

This was discussed on a gun board re a guy who 1) wanted to buy a firearm and 2) smoked marijuana.

For those who don't know, when you buy a firearm via a licensed dealer, you must fill out a form 4473. On that form is a series of questions that include a question about pot, viz. do you smoke pot. If the answer is yes, then you're disqualified.

Even though Colorado says the drug is legal, the federal government disagrees.

I was at the LGS/shooting range today. (Note: "LGS" means "local gun store".) A guy was in there asking about buying a gun. He asked how he needed to answer the question about illegal drug use if he smokes MJ now that it is legal per state law in CO.

LGS was a little shocked that he was so open about asking. LGS said that if he is a user of MJ he needs to fill out the 4473 that he is an illegal user of drugs. He then proceeded to argue that MJ was legal by state law and the 4473 asked about "illegal drug use". The LGS said it is a federal form and still against federal law.

He then said he would fill the form out saying wasnt and illegal user. LGS won though, and said regardless of how he fills the form out, they have reason to believe he is a prohibited person and they wouldn't sell him a gun. Then they asked him to leave the store.

I suspect there are going to be a ton of unintended consequences re the legalization of marijuana at the local level. But time will tell if making it legal is an ok thing or if it's going to be a horrendous mistake.

People who smoke dope can react in all kinds of ways. Often dope smokers use other drugs and/or alcohol, sometimes at the same time. Very bad stew of toxic crazyness ensues.

Four. In my entire life. But I learned this from a friend who is a certified “gun expert”. I probably misunderstood part of what he was saying or drew inaccurate conclusions from its implications.

As a former drug user, you won’t find anyone more anti drug than me. And marijuana can definatly cause problems in a person’s life, including (but not limited to) preventing them from saving money...having said all that, let’s be honest about some things, shall we? I have been in many smoke filled rooms, and I have been in many places where alcohol was being consumed. The simple fact is that people are 10X’s as likely to do something stupid while drunk, as opposed to high. It’s hard to find a violent pothead, but easy to find a violent drunk. So, in response to your reply about “cry me a river, stop smoking dope”, I’m fairly confident that if you went to purchase a gun and were told “we can’t sell you any guns because you stated here on the form that you drink alcohol”, you’d be pissed. And I bet you’d be even more mad if someone told you “oh, get over it, stop drinking poison”.

I agree that drugs are harmful, period. However, I find it quite comical when people I know in real life complain about potheads, and how they are damaging their bodies, as they sip their rum and coke. Pot calling kettle.

On a side note, I have attempted to post a piece of political satire regarding the stupidity of Micheal Moore twice now, and for some strange reason, some admin keeps blocking it. Considering the fact that it bashes liberalism (something I’m fond of doing these days since I have become much more conservative since I quit doing drugs), I don’t see why it isn’t allowed to be posted. I could see if I wrote an article entitled “Communism rocks”, but not being allowed to post a piece of satire slamming liberalism on FR is akin to getting kicked out of church for wearing a crucifix...what gives?

Dope smokers drink for the purpose of taking the paranoia out of the initial high and make fallacious arguments about drinking being worse. They should try doing neither for a few years in order to avoid feeling withdrawal symptoms for any kind of drug. As for carrying or discharging firearms while intoxicated, people who get high on smoke are always high.

Yeah me too, except it is a bit chicken and egg.

Smoking dope and doing drugs makes one a liberal mush head.

That’s the biggest problem with it for society.

Alcohol doesn’t in general.

Pot smokers have a high rate of crazyness.

I haven't researched this subject as pot is still illegal in my state. But my wife is a surgical PA and sees information about this (along with a lot of other miscellaneous medical information). She tells me there is a very high rate of psychosis and dementia among long term pot smokers. She got this information from medical journals circulated among physicians, PAs, etc.

Colorado might discover issues they hadn't planned on. Then again, they might just discover that pot is the benevolent drug that many Freepers want us to believe it is. Time will tell.

Same thing with every other state that has a Medical Marijuana law.

I'm curious. Aren't there prescription drugs that have marijuana's active ingredient? What is it, THC? Or something? That's entirely different from the whole medical pot store concept.

Is that still a disqualifier? I'm assuming this would be a drug approved by the FDA, therefore federally legal. Part 'e' of the 4473 says, "Are you an unlawful user of ..?"

If there is such a drug, then it's federally legal therefore, the user/patient can still truthfully answer question 'e', "no."

Me too. You'd have to watch how closely they pay attention to the Laws of Safe Gun Handling, but otherwise, you'd be OK. I think it would be an interesting experiment as far as targeting goes. Pot relaxes you, but at the same time, can bump your paranoia. That might actually be a good combination.

OTOH, pot makes you really stupid, which is why I don't smoke it. This is why you'd have to be vigilant on the Laws.

The upside of that, is I've heard that if you take something apart and put it back together again enough times, eventually you will have two of them.

I agree with what you are saying to an extent. Once a person quits drugs and begins to take responsibility for their own actions, instead of constantly playing the “blame game”, political opinions have a tendency to shift to the right. Mainly, I’m just tired of these limousine liberals like Mr. Moore who have never been homeless trying to sell people on the idea that the majority of poor and homeless people are just victims of “bad luck”. Having been homeless on more than one occasion, I can say with first hand knowledge that the overwhelming majority of the homeless aren’t doing anything to try and improve their situation. I can recall living in Ft. Walton Beach, Fl, before I moved to Houston, and going to places like the Salvation Army for a meal. I didn’t have money for food because I spent my money getting high and drunk. At least I can honestly admit it. I was an idiot for doing it, and I’m glad I finally put all that behind me. What really used to anger me though were the other homeless people in line for free food complaining about the food they were being served. “Oh no, not rice again!”. If something is free, you have no right to complain about it, in my not so humble opinion.

Anyway, I now live in TX, and despite my past mistakes, I am proud to say that despite the fact that I qualify for food stamps, I have made the decision to not apply for them. Now that I don’t waste my money on getting messed up, I find it’s not so hard to save money after all. I could go on and on about the lessons I’ve learned over the last so many years, but I don’t want to ramble. I will say this though, I moved here to restart my life, and I did. I found a job within 2 weeks of moving to Houston. Unfourtunatly, it was magazine sales over the phone, and I didn’t meet the quota. However, I get up every morning and go look for other jobs, in addition to submitting my resume online. I know that no matter what the future holds, at least I can face it with a clear mind now.

Here in Oregon the supreme court ruled that a pot-card holder cannot be denied the right to a CCW, maybe the courts will say the same thing about a 4473.

Pot-heads should be locked up in a nature reserve somewhere far from civilization

Common sense would suggest transactions that do not require a 4473.
