In addition to people using vaping to inhale nicotine they are also using it with cannabis.

It provides the same effect without inhaling any smoke.

I will stipulate that it’s better than inhaling smoke, but it is a drug delivery device that is presently used for delivering the addictive drug nicotine, but which has all sorts of other uses, and unintended consequences. These things should be FDA regulated and subject to the same controls as other medical devices. That will not reduce their effectiveness as an alternate way of delivering nicotine.

You folks on this thread realize this is what happens when government overtaxes and over-regulates a legal product, right?

You cannot regulate the free market or human behavior. Many have tried. All have failed miserably.

The whole push behind banning cigarettes was supposed to be second hand smoke affecting non-smokers and those around the smokers. Vaping does not do this, especially if there is no nicotine. Could it be an annoyance to others? Yes it could but banning it on the possibility of health reasons without evidence is stupid and infringes on freedom. It also presupposes that the government has the right to tell individuals what they can and can’t do. It’s one thing to regulate civility in public areas and another to just say it looks like smoking so ban it.

I don't see in Art. 1 Section 8 where congress is authorized to make laws concerning medical devices.

That police power, like most police powers, belong to the States.

Are you sure you are at the right site? This is a conservative site for a constitutional, limited government.

The Nanny State sites are elsewhere.

12 ounce brown bottles are drug delivery devices too. I don’t mind Vapor users. There is a shop I visit frequently where EVERYONE is on the things. The shop doesn’t stink like smoke. AND production is up because the guys don’t take smoke breaks all the time. It’s a heck of a lot better than the spit cups from tobacco chewers that pollute some of the shops I work with. Gross.

The root of this whole discussion is the bureaucratic regulation of human commerce.

It rarely (if ever) works well, and it always results in unintended consequences (usually negative).

Frequently, the “solution” is worse than the “problem”.
