Former ‘Seinfeld’ writer wants judge to toss $1 million defamation suit filed by real-life Kramer

There’s nothing wrong with shouting, “Not that there’s anything wrong with that.”

That’s the argument from a lawyer for a former “Seinfeld” writer who is asking a judge to dismiss the real-life Kramer’s $1 million defamation lawsuit against the scribe.

Kenny Kramer, 70, sued writer Fred Stoller and Skyhorse Publishing last December for saying in a book that the guides on Kramer’s Manhattan tour buses drive through Greenwich Village pointing out gay people and yelling a famous line from the show: “Not that there's anything wrong with that.”

Stoller's lawyer, David Pierce, insisted in Manhattan Supreme Court Wednesday that the case should be tossed because the line is ironic.

Besides, he contended, nobody on the street can claim to be insulted because the windows remain closed on Kramer’s air conditioned buses and the guides can’t be heard on the street.

But Kramer’s lawyer, Fred Lichtmacher, shot back: “It’s not ironic. It’s insulting to a lot of people.”

Lichtmacher admitted that he’s seen only one episode of Seinfeld in his life.

I'm glad Kramer’s not here. He’d be upset — and [show co-creator] Larry David would be very very upset.”

Lichtmacher said the problem with the seven “vicious” pages that Stoller wrote in his memoir, “Maybe We’ll Have You Back,” about Kramer is that they are just not true. He said Kramer’s buses never go to Greenwich Village. In fact, he said, they never get south of 42nd St.

However, he argued, Kramer's business could be hurt if the book creates the impression in people’s minds that he’s a gay basher.

“What he’s accused of is a disgusting, hateful thing,” Lichtmacher said. “This thing (the bus company) has his name all over it. This is a situation that can destroy this man’s business because no body wants to get on his bus if his reputation is as a gay basher.”

Manhattan Supreme Court Justice Barbara Jaffe said she would rule on the motion to dismiss the case in coming weeks.

In a famous episode of the hit sitcom, characters Jerry and George, who are straight, are mistaken as gay.

When the characters deny that they are romantically involved, they quickly add, “Not that there’s anything wrong with that.”
