BOISE, Idaho (AP) - A federal magistrate judge has ruled that Idaho's ban on same-sex marriage is unconstitutional.
U.S. District Magistrate Judge Candy Dale wrote in the ruling Tuesday evening that Idaho's laws banning same-sex marriage unconstitutionally deny gay and lesbian citizens of their fundamental right to marry.

Otherwise ugly single people could go to court to demand they be assigned a spouse...or have the same benefits as married people have.
There IS rational reason to deny homosexual marriages...they ARE second class because the primary biol;ogical reason for marriage and pair bonding is to create and raise children.
They cannot do that for whatever reason,,,either choice or predeliction. It is also being discovered that children abused by being raised by these broken people suffer consequences they do not wish to admit.
DAMN these meddling judges. I hope the Idaho wins on appeal.

Where does this right exist? Is it in a law, codebook, constitution, rule, or something? Because it looked like Idaho actually had a LAW against it so if this right exists elsewhere it must trump the law as written.
And "fundamental"; where did that come from? Does that make it more of a right than other rights? While at least one man I know of who transported a firearm thru New Jersey to take to his legally allowed home in another state languishes in jail and his 2nd Amendment rights are blatantly violated?
Maybe Judge Candy could set him free, I mean, as long as she's now enumerating Fundamental rights...

Has the Pro-Traditional side even won a case since the Windsor decision? Kennedy knew what he was doing. He claimed the marriage was a state affair and did not technically rule on the constitutionality of CA Prop 8. But when he brought out the animus language that was a signal for the judges to throw out that state laws/amendments.
Opinions on abortion have changed somewhat in recent years. Now more than half of Americans might be considered pro-life. I think that part of the reason for this is the refusal to be silent. I don’t mean an in-your-face, strident attitude, but a respectful willingness to say that you think that abortion is wrong. Pro-life forces have also been on the offensive, not always on the defensive. Cries for overturning Roe v. Wade, whether there is a chance of that happening or not, tended to put abortion proponents on the defensive.
The fight concerning homosexuality has not yet followed that same path. Those of us who oppose homosexuality have obviously been on the defensive for years. (I am speaking of us as a group. I personally have not, and I know that many of you have not.) It is past time for a renewed effort by all to respectfully speak out, saying that we believe homosexuality to be wrong. We also need to regain the offensive. I think that one minor way to do that, at least in part, is to begin calling for the repeal of Lawrence v. Texas.

These marriage amendments are dropping like flies. Ultimately the Supreme Court is to blame as they opened door for this.
If this stinking putrid “judge” does not like the law then she can go and petition the legislature to overturn it. She cannot order it.
Ukraine is a wonderful lesson in freedom and tyranny. Both Russians and Ukranians have put their bodies in view of snipers and stopped tanks with their bare hands. Because they believe and they are not scared to die for their cause. Our tyranny is a much softer kind, more red tape than barbed wire, but we ourselves are softer. Most Christians will just shrug their shoulders and move on, not enough people are willing to stand in front of a tank over this issue.

Yes, Lawrence needs to be repealed, but navigating such a case to the SCOTUS that would overturn Lawrence may be somewhat complicated.
It would take a plaintiff to sue a state on the basis that the legalization of sodomy infringes on their constitutional rights.
How about sexual deviancy being a sign of mental illness? That they are high functioning in other areas, doesn’t make them sane.

Fighting the normalization of homosexuality is harder, but it can be done. We need social science stats and a regular campaign pointing out that homosexuality is abnormal and that the APA’s switch in 1972 was done for politics and not for science.
Homosexuals, like heterosexuals, have the identical right to marry - that is, to form a legally-recognized relationship with a member of the opposite sex.

I think SCOTUS established marriage as a “fundamental right” in a case allowing prisoners to marry. But I can’t remember more than that - will have to look it up.
These marriage amendments turned over to the government (or rather validated) a crushing power to redefine natural law and demand that we bow to its newly created "reality".
Banning "same-sex marriage" bans something that does not exist in the normal world of biology, reality and reason. However within the legislation, the perverted fake construct of SSM was created passively, out of nothing.
Anyone who challenges and mocks the blatant lie of "same-sex marriage" is poking the beast in the eye and telling it it's wrong and stupid and doesn't have the authority to define reality. The beast doesn't tolerate such disrespect nor any suggestion that it isn't the highest power in the land.

The actual overthrow of Lawrence v. Texas would not be required for there to be some benefit to calling for its repeal. Simply calling for its repeal would to a certain extent put us on the offensive and the homosexual agenda on the defensive, causing them to utilize time and energy to defend it that might otherwise be used to bring further court cases, etc. for their agenda. It would also perhaps stiffen the spines of many on our side and give courage to those who might now only oppose homosexuality in the safety of the shadows rather than in the bright light of day.
Because it’s a Federal Judge and they have no authority to do that as it’s based on the Federal Constitution.

Good point. And that is how SCOTUS is responding. They are obviously taking two paths on two issue and just letting it “sink in” via lower Court rulings.
1. When they struck down DOMA and took a hands off approach to Full Faith and Credit etc, it is clear that it is just a matter of time before “Gay Marriage” is the law of the land and it may not be outlawed.
2. 2nd Amendment. SCOTUS has let several Cir Court decisions stand that permit a State to limit gun ownership to in home protection only. Now while it appears it will leave this to the States, it is clear they do not think that the 2nd Amendment extends to anything more than home defense and hunting.
The world in which we find ourselves. I’m glad I’m quite old.
