Judge strikes down Idaho's same-sex marriage ban

BOISE, Idaho (AP) - A federal magistrate judge has ruled that Idaho's ban on same-sex marriage is unconstitutional.

U.S. District Magistrate Judge Candy Dale wrote in the ruling Tuesday evening that Idaho's laws banning same-sex marriage unconstitutionally deny gay and lesbian citizens of their fundamental right to marry.

::sigh:: there is no right to marry.

Otherwise ugly single people could go to court to demand they be assigned a spouse...or have the same benefits as married people have.

There IS rational reason to deny homosexual marriages...they ARE second class because the primary biol;ogical reason for marriage and pair bonding is to create and raise children.

They cannot do that for whatever reason,,,either choice or predeliction. It is also being discovered that children abused by being raised by these broken people suffer consequences they do not wish to admit.

DAMN these meddling judges. I hope the Idaho wins on appeal.

can someone help me out here?

Where does this right exist? Is it in a law, codebook, constitution, rule, or something? Because it looked like Idaho actually had a LAW against it so if this right exists elsewhere it must trump the law as written.

And "fundamental"; where did that come from? Does that make it more of a right than other rights? While at least one man I know of who transported a firearm thru New Jersey to take to his legally allowed home in another state languishes in jail and his 2nd Amendment rights are blatantly violated?

Maybe Judge Candy could set him free, I mean, as long as she's now enumerating Fundamental rights...

Somebody call Claire Wolf, because I think the time is now!

Has the Pro-Traditional side even won a case since the Windsor decision? Kennedy knew what he was doing. He claimed the marriage was a state affair and did not technically rule on the constitutionality of CA Prop 8. But when he brought out the animus language that was a signal for the judges to throw out that state laws/amendments.

Opinions on abortion have changed somewhat in recent years. Now more than half of Americans might be considered pro-life. I think that part of the reason for this is the refusal to be silent. I don’t mean an in-your-face, strident attitude, but a respectful willingness to say that you think that abortion is wrong. Pro-life forces have also been on the offensive, not always on the defensive. Cries for overturning Roe v. Wade, whether there is a chance of that happening or not, tended to put abortion proponents on the defensive.

The fight concerning homosexuality has not yet followed that same path. Those of us who oppose homosexuality have obviously been on the defensive for years. (I am speaking of us as a group. I personally have not, and I know that many of you have not.) It is past time for a renewed effort by all to respectfully speak out, saying that we believe homosexuality to be wrong. We also need to regain the offensive. I think that one minor way to do that, at least in part, is to begin calling for the repeal of Lawrence v. Texas.

Like hell it does!!!! They are free to marry anyone of the opposite sex they choose and who also chooses.

...and furthermore we the people say, that one black robed federal excuse for a judge, has no authority to have any say in the voice of the one point six million people of the state of ID who are under law that marriage is between one man and one woman.

Your judgment is null and void, as in unconstitutional.

No “judge” has the authority to make law from the bench. The Idaho legislature has passed a law banning same-sex marriage, therefor homosexual marriage is illegal in that state. PERIOD!

If this stinking putrid “judge” does not like the law then she can go and petition the legislature to overturn it. She cannot order it.

Ukraine is a wonderful lesson in freedom and tyranny. Both Russians and Ukranians have put their bodies in view of snipers and stopped tanks with their bare hands. Because they believe and they are not scared to die for their cause. Our tyranny is a much softer kind, more red tape than barbed wire, but we ourselves are softer. Most Christians will just shrug their shoulders and move on, not enough people are willing to stand in front of a tank over this issue.
