GRAND JUNCTION, Colo. This is a Christmas season unlike any other in United States history, especially for Colorado, as the marijuana industry is trying to get a piece of the holiday shopping dollar. While it is technically legal for people to gift pot to adults 21 and over for the holidays this year, there are some boundaries you may want to be aware of.
Giving marijuana as a Christmas gift is technically legal, as long as it is given to someone over the age of 21. While selling recreational marijuana is still banned in Mesa County, smoke shops selling accessories to marijuana use have had some holiday shoppers themselves.
"December has been a good month for us," said Antonio Klopfenstein, with Vivid Smoke Shop.
For smoke shops here in the Grand Valley, this holiday season has been full of adults coming in to purchase marijuana related accessories. Across Colorado, marijuana shops have been using sales to attract holiday shoppers and the Vivid Smoke Shop says they have seen more Christmas shoppers this year now that marijuana is legal.
"Over the past week or 2, we've see a big wave of people coming in to buy stocking stuffers, grinders, chillums and pipes for their friends and gifts," Klopfenstein said.
While gifting pot to another adult may be "legal", there are a few things to be aware of. One being that the gift must stay within state lines, and cant be mailed as a gift even within city limits since the post office is a federal agency.
"You cant even put it in the U.S. Postal Service to go within the city limits, because it is still federally illegal, said Dave Stassen with the Grand Junction Police Department. So it would be illegal to try to mail marijuana even just across town."
The area where gifting marijuana may get the giver and the receiver into trouble, is making sure the recipient only has 1 ounce of marijuana in their possession after your gift. This is because the state constitution only allows the transfer and possession of one ounce of marijuana.
"If you are going to give it to somebody who also likes to bide in marijuana and they've already got an ounce on them, now you're giving them another ounce for a gif, Stassen explained. Now they've got 2 ounces and they are in violation of the statue."
The most serious aspect of pot as a gift this holiday season the Grand Junction Police and local smoke shops cant stress enough, is making sure that you only gift pot to someone over the age of 21 years old.
"A lot of people think oh marijuana's just legal across the board, and it's not. You have to be over the age of 21 years old to possess marijuana," Stassen said.
The rules are different when it comes to giving marijuana to someone out of state. Visitors to Colorado can legally possess no more than 1/4 of an ounce of pot, meaning it would be illegal to give to an out-of-state relative or friend more than that amount.
When that state goes to hell and is overrun by the Kalifornians and Oregonites (and similar kind), the mountains are covered by hotels, and the natural beauty destroyed we can justifiably say it went to pot. Just so you're aware, CO has always been known for MJ...it's just out in the open now. Absolutely nothing has changed as far as use goes since it's been legalized. It's by no means a new thing here in CO.

And the usage is going to go way up now that its legal and the employees and politicians of that state will partake and I bet you’re going to see the effect of that throughout the state. You know Some time ago I lived in a pretty nice neighborhood. Everyone kept their houses painted, their yards trimmed, and their streets free of clutter. I remember the day one of the houses was painted fluorescent yellow with purple trim. A little while later another house got painted the same but with a real ugly shade of green. They stopped keeping their yards up. I knew it was time to move so I did. That was 10 years ago. Last week I decided to drive down that street. Now it is dominated with yards that are unkempt, houses that have boards falling off teir houses with decaying roofs and many are ainted with bright fluorescent or mismatched colors. I am so glad I moved before the real infestation began.
Common misconception. Those that used before it was legal will continue to use. Those that didn't use before will continue not to use. Just because it's legal doesn't mean the whole state is suddenly going to start toking.

A lot's happened in 10 years...pot's only been legal for one of those years. There's a lot more involved in the decline of the State. It didn't suddenly crash when pot was legalized.

Yep. Potheads run local governments (including Republican majority counties, and small town retail businesses on the Range. They do their utmost to run non-dopers off. Most of them are originally from states like New York and New Jersey, including those more recently from the west coast.

Thus far, there's been no "hordes". They keep trying to say the homeless population is booming, but the fact is, the homeless population has been booming since long before pot was legalized.

Not hardly. Also, the Front Range IS dominated by leftists...pot is hardly the issue. Those that truly want individual freedom support the legalization, whether they use or not, because they realize that it's no one's business what they grow in their backyard and smoke in the comfort of their own home. The leftists HAVE taken over the Front Range and are destroying it very quickly (to the point that those of us over here on the Western Slope don't think of the Front Range as Colorado anymore), but this has been going on, once again, for loooooong since before pot was legalized.

I was talking about how bad elements creep in a little at a time and ravage an area. II wasn’t referring to Colorado. I live in another state.
