Mark Levin has always decried the abuse of the 14th amendment.

What makes me SMH is the selective enforcement of the 14th through the years. Section 3 states that no person that participated in insurrection against the US can participate in any government or military position, yet there were 49 general officers of the CSA that participated in various offices of government or the military in the years after the War Between the States. Perhaps two of the most prominent were Generals Longstreet and Wheeler.

The 15th was also not enforced for almost a century.

Levin's point that an illegal is not under the jurisdiction of our government is totally valid. If the illegal gave himself over to US jurisdiction he would be detained and deported back to the country that does have valid jurisdiction.

Words mean something.

The amendment does not state: "All persons born or naturalized in the United States are citizens of the United States and of the State wherein they reside."

It instead states:"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Even a SCJ should have been able to understand the meaning.

Good points, you illustrate the point well.

As Mark Levin points out specifically in this 14 minute clip, the original author of the 14th amendment points out, you can't claim "jurisdiction" just because you showed up in the USA. And furthermore a constitutional amendment is NOT required to remedy the birthright citizenship issue.
