Scalia defended a constitutional republic. He most certainly did not support democracy. Words mean stuff.
The problem is that staying faithful to a constitution that has a fault, remains being in thrall to that fault.
So even Scalia, R.I.P., had a kind of ideal constitution in mind that wasn’t the actual one we have.
Maybe the best way we could remember him would be to put a safety valve on the USSC problem, by means of something like a Bork Amendment. A supermajority of both houses of Congress (of the membership, not just those present) could suffice to right a wrong court decision, or perhaps (my own idea, which might be good or bad) a specially arranged 50-state plebiscite.
Bottom Line, Scaliaâs death is a major loss to conservatism and now threatens the foundation of American Freedom.
Mitch McConnell needs to forcefully pronounce that he will not bring a nomination to the floor, period, end of debate.
The GOP needs to make this a referendum on so much that Scalia has done to protect our Freedoms, starting with preserving the 2nd amendment and on.
This messaging will ensure a major voter turnout, unlike we have seen in decades. People will vote to support these freedoms and the GOP candidate will win in a landslide.
At every turn the Libs will be crying, at every turn the GOP needs to say we trust the American voter more than Obama.
The Libs are going nuts, the GOPe needs to stand firm and FINALLY support conservative principles and the voters who gave them a majority.
It’s highly offensive that we know exactly how 4 of them will vote before they ever get the case.
Right down the liberal line. Every. time.
